StarTrack Parcel Missing, Seller (PCCG) Said They Will Not Do Anything Further. Startrack Showing Fake Signature

Hi OZB communitiy, I need some advice what to do next , as the seller PCCG clearly said they will not do anything further.

long story short,

  1. I purchased AMD 5950x and a power supply from PCCG, on 7th July, choose Startrack EXPRESS delivery
  2. On 13th July, Startrack tracking showing "Delivered" , at 11:59AM . But no one was at home as my wife and I both at work place
  3. When I arrived home at 5:30PM, I cannot find the parcel anywhere so I raised missing parcel case with Startrack and PCCG
  4. Startrack did not response to my case, but they gave PCCG a parcel delivery signature , which is clearly fake and not mine
  5. Startrack then gave PCCG below story : "Depot advised - The driver states when he went to deliver the parcel a middle aged (approx. 40 yo) Asian male pulled up in the driveway in a White 4WD (said they think it was a Landcruiser). This male told the driver to leave the parcel at the front door. The driver does not remember the exact name they got for the signature but did mention the name. This Asian man then walked towards the back of the house and not the front door. Driver states the male was wearing a hoodie and trousers at the time."
  6. PCCG consider parcel delivered, then start blaming my house is not secure and ask me to file a police report

    "PCCG is not responsible for the missing parcel, we have previously had this scenario tested in court, the recipient lost and also had to pay our costs.

    The goods were delivered successfully to someone at the address who gave the correct name despite not seeing the parcel yet. If there wasn’t going to be anyone home to accept the delivery during business hours and the property is not secure then you should have elected to have it delivered to your or your wife’s workplace, or use a Parcel Locker for example. "

  7. I did not believe the story that was given by Startrack and PCCG , but I file a police report anyway and waiting for response.

  8. what should I do from here? PCCG is blaming me as victim and will not do anything further. Startrack did not even bother to reply to my case(I called everyday, was told to wait for call back), only response to seller

Note for Anyone who is consider buying anything from PCCG, please be aware, if your parcel is missing , they will not care and they seems very confident they will beat you in court :)

I never said it was a VCAT case, there are courts in every state of Australia.

There is no further action we can take with the courier and no resolution we can offer you. You having evidence of being at work still doesn’t address whether someone else you knew or who lives at the property accepted the parcel.

Feel free to lodge a complaint with VCAT if you would like, but if you have already lodged a charge back with your credit card company then the funds will be reimbursed to you and there will not be any loss for you to recover which would make it difficult to bring action against us. We have done nothing wrong here and it is genuinely a shame you cannot understand that fact.

Any further emails will not be responded to. You will need to shop elsewhere in the future.

    Startrack don't have to respond to you at all as there's no contract or agreement between you and them. They are contracted by PCCG which is where your case and issue lies.

    This is a tricky one as can see the other side of the coin as well, what if that story was actually real and that person was legit homeowner. How would I (as PCCG) know you haven't received the item and aren't trying to scam us? (Not suggesting you are at all, but showing alternative perspective.)

    This sounds like something you'll need to raise a case to consumer affairs equivalent as clearly been scammed yourself. Sorry to hear that!

      I have co-worker at work who can prove that I am at work on that day , wife have co-worker can prove she is at work that day.. my 2 year old daughter is at Childcare

        Might be worth getting some legal advice? Someone posted here for free 30 min intro session. Worth a go as looks like you're out at least a grand or so.

        As below said, might be worth speaking to Klarna too about doing a chargeback. PCCG might ban you from future orders, doubt you'll care!

    Scammed - Asian LandCruiser driver follows startrack truck.

    When startrack driver gets no response at front door said Asian in LandCruiser drives into driveway claiming he lives there.

    You know the rest.

    Are you Asian? If not you have a very strong case with that point alone.

      My guess is the driver can see my name from the consignment and either made up this story , or some Asian male was follow this driver?

      from this deal , Klarma. so it is not as straigh forward charge back, I would either need to charge back 3 times from credit card, or maybe there is other way I do not know

      • The multiple payments isn't an issue, but i'm not sure if Klarma alters the chargeback process, but i'd still try to apply for a chargeback. Most banks make chargebacks a very easy process. Give your bank a call, and say you used your credit card to pay for goods that you didn't receive, and that you've already contacted the merchant about it and they didn't help you. Your bank will be more than happy to help you and let you know what their process is and what they need from you. Then wait and you'll certainly get your money back (as long as there isn't an exclusion for using Klarma).

    When you bought your item from PCCG, do you have to option to pay a few $$ more for insurance?

    It is likely that PCCG are not liable, as they have contracted startrack to deliver

    I would initially go after startrack. They have NOT (in my opinion) taken due care to ensure correct delivery. Correct delivery to me, would be getting some ID from the receiver (in the circumstances described). If the person came from inside the house, or is known to the delivery driver, then they would be covered, but giving it to some random (effectively) in a car, does not get anywhere near sufficient to ensuring they are giving the parcel to the named recipient.

      I would assume for $1200 CPU they would have put an insurance on it, or at least require signature on delivery

        Agreed.

        As the first reply states, you don't have a contract with the 'at fault' party, but that's who carries the responsibility of correct delivery.

        You might need legal advice, that you pay for, not random bargain hunters like us.

            @ggfatty: The problem with this, is that Startrack are saying it's delivered, so there is no lost parcel to claim against. Your claim might be against PCCG, Startrack or their insurer.

      That doesnt apply to after it being delievered, only during transit even if delievered to the wrong house. Also that is scam too, "insurance"…yeah right, more like "Give us a littler bit extra for just reading this text" since the seller has to deliver whether or not they charge an extra insurance for this purpose…

    Jesus this sucks. One of the reasons why I use a PO Box for deliveries where available. If it doesn’t fit in the box, it sits at the post office.

    Really feel for OP but unsure if anything can be done and a 5950x ain’t exactly a packet of Tim Tams in terms of dollars potentially lost.

      Couriers Please don't deliver to PO Boxes. It's because they fark up so often, they won't be able to pull the same shite as happened to OP.

        Yeah look I’ve never opted for them and of the couple of times I have had to use them from sellers insisting, I’ve had problems. They’re literally the scum of the delivery world and I can’t understand how they can look at themselves in the mirror each morning knowing how much they can manage to f up what is essentially a pretty straightforward job.

        That's why you use the physical street address of the post office. E.g. Suite 100, 123 Main Street.

          • @Zachary: Yep. I asked the manager at my local post office about this when I had CouriersPlease and UPS refuse to deliver to my PO Box. Apparently you're supposed to pay for an add-on (like an extra $10/year IIRC) for this, but generally they'll overlook that. You just use Suite # instead of PO Box # then the physical address of the post office.

    I stopped buying from PCCG a long time ago. This just reinforces that.

    PCCG will have insurance with Startrack as a customer of theirs, even if you don't have insurance.

    I would contact Klarna and speak to them, perhaps they can cancel the transaction from their side.
    Otherwise, contact your bank and block any deductions from Klarna, or if they can't do that, each time you get charged, do a chargeback for each transaction.

    Bullshit. Ask them for the case number. As they are located in VIC, I can look that up and see if they are lying, which I'm guessing they are as I cannot find anything on a quick look-up. It's a scare tactic. Their only noted court case is a copyright infringement which they won

    As mentioned, PCCG must be following this up as the contract is with them. If they are refusing to help, do a chargeback. As you have used Klarna, speak to them who can arrange a refund.

      • That sequence looks like VCAT/VSBC mediation and not an actual court case.

        That is a VCAT case number. That case number doesn't exist in the portal at work. Just to be sure, I've also checked Austlii which is a public database, and there's nothing there (All 2020 cases)

        So their matter never made it to arbitration and a VCAT matter is not case law. Nothing has been tested, despite their claim. For the record, you can't file for costs in VCAT. There are no lawyers. I can assure you that it is nothing but a scare tactic. Use all the power you have against them here. Speak to the ACCC and take the matter to VCAT if necessary.

  • I was under the impression that Startrack (and all other delivery services) no longer require a signature as proof of delivery. Rather they just take a photo of where the placed the delivery. Sometimes they may actually take a photo of the person accepting the item.

      Startrack/Australia Post have a no-contact (people to people) in Qld so no opportunity for Any signature - too busy to take photos, just scan it and hand it over to whoever.

      Our address is similar to a close Street with a name similar to surname so some letters have gone there - we've had 2 of theirs that we delivered to 'em.

      I wish package deliverers would take a photo of ANY recipient and if they refuse say OK will be taken to local Post Office - pick up there - at least there's a better chance of ID check.

    I had an issue like this I signed a stat Dec with a JP and sent that to the supplier ( kogan) they started a claim with the courier, the courier stated they had GPS data and a signature to the delivery address, but a stat Dec was enough for them to do their thing.

    although the GPS data showed the driver at my units, there was no proof of the exact location of the delivery, and also the signature was also an unknown.
    they also never shared this data / GPS location with me but did provide a copy of the signature

      Just go credit card chargeback route. It's really your only choice in this situation.

      They can provide your bank the fake POD and the bullshit story and you can provide the bank a stat dec and police report number. Bank doesn't give a crap, your their customer and it's not coming out of their pocket anyway. They will reverse the charge to Klarna and Klarna will reverse their payment to PCCG.

      Just advise your credit card provider that goods were not received and let them sort it out for you. Klarna being in the middle does not really affect the process, if anything it might make it a bit easier as Klarna and PCCG will end up having to slug it out between themselves, they will have a contract and agreement in place for this.

      Also PCCG sounds like a bunch of dicks the way they are handling this.

      In a nutshell it goes something like this…. "Goods and/or services were not received by the appropriate recipient at the agreed location by the expected delivery date"

      It is their responsibility as a retailer to ensure your goods were delivered to you, if they choose to leave parcels unattended or don't obtain an appropriate signature from the actual delivery recipient they bear the liability. Startrack acts as PCCG's delivery agent and their actions are not your responsibility or concern.

          Court case crap is irrelevant. Just contact your bank. PCCG are bound by a merchant agreement they signed with their bank.

    Happy to give PCCG a big f you after reading this experience, especially with their scare tactics. I will shop elsewhere in the future and recommend to my friends and family the same. Hopefully us OzBargainers can all follow suit.

      They used to have a great customer service (5 years ago. when I had to RMA a mouse) but it has gone to shit. I wouldn't mind paying a bit more for better customer service but it doesn't seem to be case anymore.

      The fact they don't even allow pickup anymore due to "COVID" but pretty much every other store still offer pickup.

    It is the delivery drivers responsibility to make sure it is being delivered to the right person, all he had to do was ask for the name, and if its incorrect not deliver the parcel. This responsibility is to PCCG as their customer.

    The whole purpose of the signature is to confirm the package is delivered to you the correct recipient, all you need to do to prove that the signature is not yours is to get an affidavit which is then signed and dated by a justice of the peace.

    In the end it is PCCGs responsibility to make sure you receive your items, terms and conditions don't trump that responsibility. This is their responsibility to you their customer.

    If you can prove to the credit card company that the signature is not yours and that the delivery company failed in their responsibility to make sure the right person was the recipient you have a good case to do a charge back. However if you ever want to purchase from PCCG again and not get black listed this might not be a good idea unless all you care about is the money.

      I read this as a blame. Do you agree?I assume many houses in Australia, any delivery man/energy company/any man on the street can lift the lever and enter front yard. And PCCG consider my property is not safe, based on this?

      Yes I suggest PCCG should not based on a bs story provided by startrack and consider item delivered, without further action.

      Do you believe police can recover for me? Or do you think PCCG decided to let me wear the loss?

        It's not really a police matter and PCCG has essentially wiped their hands of it and are now trying to intimidate you from pursuing the matter further.

        You should however report it stolen/missing to the police and obtain a report number to provide your bank for the chargeback.

        I don't understand StarTracks insistence on your home is not secure. How is the delivery guy supposed to deliver the parcel if your home is secure and they can't get into the front yard? They are going to leave it on your front doorstep and then when it is stolen, yeah no worries your place was secure????

          If the house is not secure, the procedure is for the StarTrack driver to deliver the parcel to the local post office and leave a delivery notice card. So by their own acknowledgement they failed to deliver the parcel securely by not properly identify who really signed for the parcel.

          StarTrack failed by not delivering it to the correct recipient.

        The civil matter in regards to the contract between OP and PCCG is another issue, as well as the civil contract matter between StarTrack and PCCG.

    You have to file a item not received report with your credit card provider.

    2 weeks ago I was at home and 30 secs after a parcel was delivered a guy with a hoodie was at the front door trying to find it…

    Just lodge a Postal Industry Ombudsman complaint against StarTrack. They'll get back to you real quick. If you don't have a reference number in regards to the original contact you made that they palmed you off on, contact StarTrack again, get a reference number to show proof that you raised the concern with them, then wait the required 10 business days then contact the PIO.

    Sounds like PCCG are either lying about the court case or the person who took them to court had a lousy lawyer. Delivering the parcel to the wrong recipient is still a failure to deliver the parcel to the contracted buyer under ACL.

      It's a shame that they cannot understand that under ACL they've failed to do the right thing, and are doing the wrong thing by trying to wash their hands of it. The short end of it is they've failed to fulfill their contract.

      Funny that they say if you've lodged a charge back that your money would be returned. This is only the case if the merchant agrees with the charge back or fails to respond to the charge back. I'm not seriously starting to wonder if that would be the case because PCCG knows they will lose a charge back challenge.

      Please lodge the VCAT complaint and lodge a PIO complaint stipulating that they are committing fraud if they insist that the signature they obtained is of the person who the package was addressed or of an authorised recipient. Ask them to resolve the matter by telling PCCG that they failed to deliver the parcel as contracted or to compensate you the value of the package as indicated by the invoice from PCCG including delivery.

    They are the sender, not you.
    Startracks works for PCCG. It's up to them to do something about this.

    If there is a POD and PCCG have done the right thing, there will be insurance on the shipment.
    I've heard similar stories from PCCG/Startracks before.

    Don't want to take sides and I'm sorry for OPs loss. However, if a parcel is actually left at a doorstep and someone steals it, is it the vendor's responsibility to refund? I'm not saying this is what's happened here but just want to know what the legal position/ majority opinion is.

      If you authorised for it to be left I’d say it’s your fault. If they left it or delivered to the wrong person I’d say delivery company’s fault which the seller is required to remedy as they should have insurance with their courier for such issues.

      If that happens frequently, then seller should find a new/better delivery method. Those costs can be passed onto the buyer by a higher shipping price or item price or they accept the increase in cost and take a cut to their margin.

      • Star track provides cheaper shipping rates with ATL (authority to leave) specified, PCCG knows exactly the level of service they are paying for.

    The hypothesis for a scam sounds plausible, I suppose the driver should have ensured the person claiming to be the recipient could open the front door or something like that to prove they're resident.

    OP, I would recommend getting a doorbell camera for your property. Something like the Eufy one which stores videos in the homebase which you set up inside your house will give you something to work with in the future. I often get deliveries sent to the wrong address… if I don't have a video record of the courier dropping it off, I know they've stuffed up.

    Also consider getting a PO Box as others have said. They're worth the money if you have lots of things being delivered.

    If what you are saying is true [and i tend to believe you], then they are a lying & it is a case of theft.

    This is what I hate about "Signature on delivery". If i am not home or someone else in the house does not open the door, I don't want it left in a safe place. PCCG now claims OP's property is not secure. It's not up to them to claim what is secure or what is not. If there was a signature on delivery & someone from the house did not open the door too sign and collect, it should be either taken to a depot or Auspost or rescheduled.

    I would pursue this, don't let scum like PCCG get away with trying to wash their hands of such an expensive purchase.

      Hopefully the buyer used a credit card as merchant facilities add-on performance criteria to the contract of sale that must be accepted by PCCG prior to having access to merchant facilities. I always pay by credit card, gives a lot more recourse.

      TLDR; There's more than one way to get a refund.

    This is a terrible situation, but going to your bank would be the best option and let them sort it out.

    On deliveries in general:
    Not all companies deliver to parcel lockers (which is a damn shame).
    Virtually no one will provide guaranteed delivery dates/time at point of order. Even something like "I work from home on xx day" is virtually impossible.
    Businesses often don't like individuals receiving stuff at work.

    … which makes the whole thing hard.

    COVID and no signatures means lots of packages are just left on door steps ripe for the stealing and following a delivery truck and pinching all the packages sounds like an easy and relatively low risk endeavour for the thief.

    I hate going to the post office to pick up stuff, especially when the cards are left over the last 18 months when I have damn well been at home. I also have cameras on the outside of my house, the number of times I have received "delivery failed, no one to accept package" messages for stuff and can 100% prove zero people attended my house (while I was home too) is amazing. I would accept if I got a message saying "sorry we ran out of time, will be rescheduled for tomorrow", as long as it was the exception and only once per package, but delivery failed… that annoys me.

    I have often wanted a locked storage box (with a digital code) at my door large enough to receive parcels. Then I could put in the instructions the delivery code and the driver could put the package in the box securing it and take a photo as proof of delivery (and I would like a camera built into the box for me). The problem is most places don't accept this as secure and still want an easily forgeable signature. Hell, I'd pay good money for an authorised solution that some/most/all carriers would agree is acceptable… While we have been very lucky over the years, that piece of mind is definitely worth something.

    In a modern world of online shopping there has to be a better way that could meet security requirements that carriers could agree on.

    As for PCCG, I've had good experiences over the last year or so including returns for warranty and change of mind (ordered the wrong thing) which have all worked out fine. Annoying that you can't pick things up (or drop off returns), but that is the choice they have made making them less of a bricks and mortar store and more of an online store.

    Does PCCG have a rep on here?

    The number of people being put off should worry them - isn't this likely to cost them more than the CPU in the long run?

    My last experience with them 3yrs ago was fantastic so I was happy to pay a bit more for piece of mind, that's gone now.

    • Since they stopped pickup, I lost a bit of interest but by reading the way they're responding to the OP, I don't think I'll be buying anything from them in future
