Promised a Job but Then Refused to Hire after 12 Weeks of Rostering

Hi,

I am bit vexed tonight as I came to job, my manager mentioned that they have hired someone else for the position that I was interviewed for a month ago.

I was offered a new position at my workplace where I have been working from last 2 years. The manager contacted me through email saying they have a new proposal for me. They interviewed me on 29th April and were pretty happy with me.

I was proposed to work 15 hours a week in a fortnight and I have already been working for 11 weeks. There was so much backlog which I covered, working extra hours and putting in all the hard work eventually being told that there's someone else more experienced who will do the job.

I just don't know if this is right or can be done as I recently enquired about signing the job position. I work in aged care sector.

Just don't know if I should get any help or just find another job.

    Oh that's not great at all. I would start looking for a new place to work if you're treated that way.

    Obviously you were used by your manager who already had someone else selected for the position.

    If you want loyalty get yourself a dog.

    I'd be looking at moving on ASAP to somewhere where your talents will be more appreciated.

    • Yes I thought they had hired me but naah they just used me for the time being.

        I am learning slowly not to be used by my company but at the same time I do the extra mile for my own benefit to learn more things on the job and just make good connections but ultimately you are just a name on a piece of paper they can erase and delete at any time so it is hard not to attach your good will to future work benefits and progress but it is what it is.

        I am still learning a lot every day and being used all the time but I still take it as being new to the workforce relatively and ultimately new to this company and their extensive work sites and work staff etc.

        It sucks because sometimes it feels like something is a sure thing but really you are just their number one guy for now until they find their real number one guy :(

        Feels bad if it makes you feel better my work is making me do stuff outside of my job description all the time and I don't get anything extra for it but a snide heartfelt sometimes thanks.

        The kids at school though are nice and make it worth it.. some of them are too pure and innocent for this world I just look at them and go oh shi that was me.

    Yeah that’s pretty terrible, but not uncommon. If they didn’t officially offer you the job permanently or give you a contract you probably don’t have many options. Probably best to keep the relationship for references and future opportunities, but start looking elsewhere, using the higher level experience to help your chances.

    No contract was signed nothing they didn't give me any documentation just because I have been an employee already. I am working two different positions for the same company at two different sites. I don't think there's much to be done to it rather than just accepting the situation and moving on. But thanks for your replies.

      Nothing employment related is worth it's salt without something in writing.

      Managers can and do promise the world to get more out of you but can pull out or not provide due compensation.

      • Agree, nothing's done until it's done. What you do next is up to you, but other than asked some pointed, but professional questions about the situation, it is highly unlikely anything is going to change.

  • I would go back to your previous position ASAP and stop working for the new d*(head manager who has been playing games with you. If the new manager ask's for help make up some excuse that you have family commitments etc and say sorry you cannot help.

    It is a breach of the ACL to engage in misleading or deceptive conduct in relation to employment. In your case that might be in leading you to believe that the position was yours - however the real question is what you are willing to do about it.

        You need to hand back your law degree Davo - or maybe not argue about the law with someone who actually has a clue about it???

  • If I do something, I will be in trouble and manager would trouble me on other days when I am working in my other role at same workplace. So, I might just need to leave this place. Not sure what ACL stands for.

    If you don't have any leave owing, line up an another job and give them 1 hours notice on a Friday that you won't be coming in Monday. Or, just call in sick until your leave runs out meanwhile you've started the new job elsewhere.

  • Going by the timeline, you were already doing the work before you were interviewed, which suggests it was just extra duties until they filled the role. So long as you got paid for it, there's really not much you can do.

    Aged care recruitment sucks, I've seen jobs open for a year because they simply can't find someone. It's probably just bad luck that they found the person with more experience when they did, but it's a field of low pay and huge competition, might be time to look at whether another workplace would offer you a similar promotion?
