Hi there,
Seeking advise, personal experiences, any insight and wisdom for the following:
I'm in QLD. In Brisbane. I'm in a 400m2 house in a lot that's in a body corporate with other lots. There's no physical connection between me and the other properties. I have my own driveway, own electricity but do share water (I can connect to the road adjacent to my house but will likely have to rip up my driveway to make that happen which is fine it's an old driveway). Suffice to say I've ruffled some feathers with my BC and the other lot owners have asked me to leave the body corporate as a means of settling an argument over some money they've mishandled. I'm looking at it as a positive thing as I pay around 5K a year in BC fees and would see a major increase to my property value of probably around at least 100K.
What's my next step? Has anyone done this? Any rough ideas on things I need to sort out with regards to water/sewer etc?
I have all the lot owners agreeing to seeing me go so that step is sorted. I just need to figure out the rest.
I did speak to a subdivision company and they're saying there might be an issue with sewer/stormwater. I haven't seen my drainage plans for my lot but there's a sewer and stormwater pipe located in common property behind my lot. I'm assuming I'm hooked up into that already and was under the assumption that it shouldn't be a problem as those pipes have an easement right from the city. If need by I'm sure I can arrange to have my pipes have an easement right through their property or I can try to negotiate some portion of the common property to be transferred to me when I separate as it's on a hill and is useless to anyone but me as I could extend my backyard a few meters.
Water will be the other issue as I will need a hookup as I draw from the lots below, but again, that's just tearing up my driveway and hooking it up to the water pipe in the road in front of my house and then capping the other pipe, so I don't see a major issue there. Obviously will likely need surveyor, lawyers, and whatnot.
Any suggestions? Any input? Any ideas? Anyone have any recommendations of anyone in Brisbane I can talk to or use as a consultant to make this process move forward?
Thanks
Lawyer time I reckon, so you can find out what the law says you need to separate.. they could also help in estimating the whole total cost of separation from the mainland so you can work out if you want to proceed.
