Thanks for your comment. It is not the same thing. Be aware that most massage guns like these are not registered in the EESS database as responsible suppliers nor the massage gun battery chargers have the Regulatory Compliance Mark (RCM) / SAA certification. Any massage gun battery charger which does not have the RCM / SAA is unsafe for use and illegal to be sold in Australia. In a nutshell these unsafe massage gun chargers can burn down your house but you will not get any insurance because you have used an illegal product unsafe for use. As a consumer you have the right to ask these sellers to provide you with the SAA certificate before you purchase. Also beware of sellers who disappear after selling you a fake, counterfeit, or unbranded product because if they last only 10 minutes (as most of them are not quality tested and uncertified for sale in Australia) you may not receive any refund or compensation.

          • @asankar45: LOL RIGGGGGGGHT

            • @wtigers: Yes, they are fake. As with any other popular brand there are many sellers infringing on the PHOENIX trademark. You could contact this seller to provide PHOENIX trademark rights certificate from U.S. Patent and Trademark Office or IP Australia. Then if you are interested visit the World Intellectual Property Organisation (WIPO) here >> [https://www3.wipo.int/branddb/en/index.jsp] and search for trademark registration number 1572525. You will see that PHOENIX is an Australian brand protected by IP Australia along with other jurisdictions such as EU, NZ, CH etc. including China. Further as a consumer one would need to always think about safety of the product and after sale service before purchasing any product online especially from an overseas store.

              • @asankar45: So why you haven't taken any action against these fake sellers ? What's the benefit of this WIPO and IP Australia then ?

                • @ChipsChicky: @ChipsChicky thanks for your comment. We are taking action, however it is a slow legal process compared to the amount of fakes popping up everywhere. It is also not simple to take legal action against an overseas entity. Therefore, it is also the responsibility of the consumer to assess the authenticity of online retail stores. Consumers need to be vigilant like never before. One sign of an authentic Aussie store is its partnership with buy now pay later services such as Afterpay, Zip and Laybuy. Another quick check is to google the product. For example in this case you can google Phoenix A2 pty ltd. You would see an Authentic google ad or you will immediately see the business location with address in Australia and business listings for the service area on page 1.

However, once you receive a product, especially an electric product you need to verify its safety certification by checking whether it is certified with the RCM mark. Else you need to report the unsafe item and the seller to the authorities.

We are contacted by a considerable amount of Australians who thought they bought an authentic Phoenix massage gun but actually bought a fake which didn't last long. The stores they bought from had already disappeared and they are left with a defective, uncertified, unsafe massage gun without any aftersales service and lost their money.

                  • @asankar45: So, someone making and selling a fake Phoenix gun wont be able to make a fake RCM mark ???

                    • @ChipsChicky: They could. However, these fake sellers are mostly unaware of these local regulations for one and they would face heavy penalties for such an action when exposed sooner or later to the authorities.

    • His massage gun posts on Ozbargain ..

    • Thanks for your comment. Beware of fakes. phoenixa2.com is the only authorised store for the sale of "Phoenix" branded massage guns. Also be aware that most massage guns are not registered in the EESS database as responsible suppliers nor the massage gun battery chargers have the Regulatory Compliance Mark (RCM) / SAA certification. Any massage gun battery charger which does not have the RCM / SAA is unsafe for use and illegal to be sold in Australia. • wait, are you telling me everyone else selling this product?

        https://www.amazon.com/Phoenix-Percussion-Massager-Vibrating… $145.00

        are selling fakes?

        • Yes, they are fake. As with any other popular brand there are many sellers infringing on the PHOENIX trademark. You could contact this seller to provide PHOENIX trademark rights certificate from U.S. Patent and Trademark Office (since this link is from Amazon USA). Then if you are interested visit the World Intellectual Property Organisation (WIPO) here >> [https://www3.wipo.int/branddb/en/index.jsp] and search for trademark registration number 1572525. You will see that PHOENIX is an Australian brand also registered in the USA and protected by IP Australia along with other jurisdictions such as EU, NZ, CH etc. including China. Further as a consumer one would need to always think about safety of the product and after sale service before purchasing any product online especially from an overseas store.
