        Seriously guys, you need to your own product before you sell them. Prepaid mobiles (these arent outright, outright mobiles are sold in the plans/mobile phones section) come locked to the Telstra network unless theyre Nokias, which at one time were sold at one time "unlocked" but were actually locked but able to to locked without fee. You will pay betweek ~$70 and ~$150 to unlock them from memory.
        Any mobile that comes with prepaid credit etc are locked. check the t&cs and look at point 1 on the page where it says: Samsung Galaxy 5 mobile phone1 in bold and hover over the 1 it will say Network Unlocking Fee Applies

  • Almost all Telstra Pre-Paid mobiles, especially those part of starter kit (as this one is) are locked to Telstra. This was an industry standard and seen as a partial subsidy, as long as you stayed on the network and spent a certain amount the shortfall in handset costs would be made up in network charges. If you left early the shortfall would be covered by the unlock fee.

    This deal is different to the galaxy tab deal as the tab was never locked. It was seen and sold as an accessory, that's why in the original site plan it was listed there. It was not part of a starter kit.

    It may well be unlocked. But the likelihood of Samsung recalling all the stock from Brightstars warehouse to unlock and then sending them back is low, especially given that this product is near the end of it's production life - hence the sale. It may be that they have instructed Prepaid billing and activations to unlock them for free when you call but I don't think that likely either.

    I wouldn't trust Gerd all that much unfortunately. For someone who answered a customer inquiry about how to order a blank sim online with links to 24 month byo sim plans and $2 starter kits (sure technically the postpaid sim was originally blank, but when you get it it's been assigned to a number and the service activated so it isn't blank anymore; and the prepaid kits is not blank) instead of directing them to perhaps a Telstra store or call; he wouldn't seem to know all that much productwise.

    On that note, I could be wrong, but if I'm not good luck lodging a complaint to get it unlocked, and remember Telstra Shop Online doesn't accept returns based on change of mind so cave emptor.

      Just FYI…it wouldn't actually be "change of mind"; it would be either NFFP or deceptive advertising! No problems whatsoever getting unlock or refund in either scenario through ACCC or FT! The axiom 'caveat emptor' doesn't really apply here for legislative protection reasons! :)

  • As I explained, if you purchase this from the Telstra Store Online and find it locked, you wouldn't get the change of mind. It wouldn't be not fit for purpose because it's a mobile. It does what it says and the specs should be right (haven't double checked). It isn't deceptive because it does give a disclaimer that a network unlocking fee applies when you hover over the "1". It's also likely to be in their SFOA or T&C. Besides, apart from ONE Telstra employee telling you it's unlocked, there's nothing on the website saying it's unlocked. Historically only postpaid mobiles were unlocked, except iPhones and that little Sony Ericsson slip up. All this hogwash about "it's listed as 'outright' on the site therefore it's unlocked" remember Telstra exists in it's own world. Every prepaid is listed as outright on the site, are you telling me they're all unlocked too? I'm trying to suspend my disbelief that this is the case. Telstras definition of outright is everything that doesn't require an ongoing commitment or isn't on a plan. That could maybe be the only clause you could escape the unlocking fee by. But seeing that you've ignored a unlocking fee warning on the main site and another one on the FAQ site your case is pretty thin.

      I think you're worrying far too much over a $100 phone dude, chillax! It's a moot point as others have found a better deal anyway!!! ;)

      I honestly don't believe that you would have any difficulty making a case under the relevant state or federal consumer protection legislation for either NFFP or deception anyway, given that the deal was effectively advertised by a verified Telstra Rep! :)

        • Agreed, and if this was some fly-by-nighter on ebay this whole moot conversation might be valid. It's not on both accounts, here's why:

          1. Telstra - not the most ethical of companies I'll grant you, but I think we can all agree they'll be around long enough for any legal recourse! ;)

          2. Deal posted by a bonafide, verified Telstra Rep…it only takes one employee to make a promise to customers, particularly a public forum like this in a formal capacity, for the company to be liable (it's called Vicarious Liability).

          3. If Gerd says it can do something in this formal capacity (advertising), and you buy it for that function only to find it will not do it, that's NFFP & you're covered by the FT Act etc.

          4. If Gerd or Telstra tried to turn around & deny they stated it performed that function, the overwhelming host of evidence to the contrary will indicate deceptive marketing.

          Either way, your hard-earned $99 is relatively safe provided you're savvy enough to step up to the plate to take steps to protect it…here endeth the lesson! :)

          P.S. I think we can also both agree that a lot of folks around here spend a lot more than $99 on a phone, so as risks go it's pretty minimal…also, feel free to disagree if you think my layman's interpretation of consumer protection legislation is off, I don't claim to be a bush lawyer; but don't just neg the comments without manning-up & contributing something! ;)
