Was Rear Ended in Traffic This Morning. What Do I Do Next?

Hi All
Driving between sites for work today and was stationary at a set of lights, heading in an uphill direction.
Kia Carnival ran up the back of my ute's steel tray.
Minimal damage to both cars on the external but subsequently…
- Steering does not feel as sturdy as before.
- I've incurred pain in my back and numbing pain in right leg (was on brake at time of incident)

Questions for the OzB community:

  1. What should be the next steps from an insurance accident POV?
  2. What should i be doing from an employer POV as i was traveling between sites at the time?
  3. Anything else i should be doing that i havent thought of?

UPDATE: Lodged claim online with budget direct. They advised the excess was payable to proceed with the claim.
Called and was on hold for 30 mins. Consultant reprocessed the claim and waived the excess as all 3rd party information was provided.

    Call your insurance company.

    Call your boss and ask about the company policies.

    Anything else i should be doing that i havent thought of?

    Go see a doctor to get yourself checked out (you should do this first).

      Will call insurance. :)
      Didn't really want to get work involved - although i've advised them what happened.
      Went to dr and they prescribed anti-inflammatory tablets

        Also record any pain that youve had - date, times, severity etc so that you can claim it down the track if it turns out to be something more - ensure you go to the doctors frequently if it doesnt go away

        future work compensation and/ or insurance claim. you might feel ok now, but you may feel worse later

        • make sure you log with work all accident details in case of future workers compensation claim
        • make sure your insurance is notified of the accident and that you were hurt in the accident
        • make sure you have a transcript of your insurance claim that shows you were injured
        • make sure your doctors records show that your consultation was a result of the accident

        If you are going to claim personal injuries best to ring your insurance ASAP and see if you have to go to their drs. Also perhaps hit up the personal injury lawyers if you can't work.

          FYI the Doctor you start with for personal injury should be your ongoing doctor.

  • your motor vehicle insurer may redirect you to claim under Workers Comp/WorkCover.

      Clearly he was going downhill on the wrong side of the road in a 1971 Dodge. He drove straight into that soccer mum.

  • What is your work travel arrangement? Are you covered under their insurance. Definitely get in touch with your workers Comp regarding your injuries. May not go anywhere if everything is ok, but having an initial contact makes life a lot easier if it doesn’t get better quickly.

    Be sure to inform and check travel arrangements with your employer - I didn't think this was relevant until it happened to me. I was rear-ended and I felt fine afterwards - the next day, however, I had bad back and neck pain.

    My employers cover extended to my travels to and from work which I assumed was all under my insurance.

      Yes, I heard this from most people who made a personal injury claim!

      It was really bad for pedestrians who walked away after getting hit, thinking they were fine, and not getting the driver's details.

    honestly there are so many of these posts. do some research

  • Go see a lawyer as you may have a claim against the TAC for any injury and pain and suffering.
    Same thing happened to me.

  • Question for OP. Why wait for an accident to ask what to do? Surely when you signed up with the insurer you read the PDS and literature they provided…. you did not enter into the insurance contract blindly?

      Good question.
      Correct, i did read the PDS and am fully aware of the claim lodgement process.
      That being said, i've always been of the opinion that if you don't need to use insurance, avoid claiming on it.
      As this was my first time having an accident on work time and resulting in injury, Budget Direct's PDS wasn't specific on this.

    • Me too… Could be in my head, but they asked about steering when mentioning about rear damage.
      Will leave it to the assessor

  • Just an update on this whole saga..
    As many would have realized, COVID-19 and the lockdowns came in shortly after this.
    - It took budget direct 2 weeks to have my ute assessed (chose my own instead of one of their assessors)
    - once it was finally assessed, they approved a replacement of the tray
    - due to COVID-19, there were supply issues which would have meant another 12 weeks to source the tray.
    - repairer called assessor to see if they could increase the insurance value by $100 to get another tray, but the assessor advised “I would rather him have a hire car for an additional 12 weeks than increase the amount..”
    - repairer paid the difference out of his own pocket and I had a Ute with a new tray back on the road 2 months from the date of the incident
