Parking Fine Issued by TMS - Need Advice

I received a parking fine 4 months ago, the company was Traffic Monitoring Services. I parked at a shopping centre for an hour and saw a parking ticket for $77 ($66 if you pay immediately) on my window screen. Did not notice that it was a paid parking. I checked with few of my friends and ignored it as they mentioned that it is not enforceable and also I haven't done any liquidated damages to them worth $77.

Not sure from where did they get my details but I have now received a letter from TMS advising me to pay the fine which has now jumped to $92.

Am I supposed to pay the fine or ask them to prove the damages worth $92 ? Will this go against my perfect credit rating if I do not pay?

    LOOOL, dont worry about it, I have gotten 5 of those letters, just throw them in the recycling bin, they cant enforce anything.

    • Thanks - but how would they have obtained my name and address? (They mentioned via a court order). That actually worries me.

        • VicRoads will not hand over any information. Unless you contact them in Vic they have no idea who owns the car.

            • @Ocker: Not in Victoria they don't. Not since the law changes 26 Aug 2015 they cannot access the VicRoads database and the courts will not hear their cases as it was wasting their time.

        And you'll get a few more too and each time the amount will go up a little more. You'll then get a letter or two from a legal firm advising the matter has been referred to them for recovery of the costs with their costs added to it - just ignore them all. Don't even respond to them. They'll give up after a while

    Maybe sue them for information on how they got your personal details. Then sue the org that gave your details away for subjecting you to harassment.

    Or ignore it.

    Just keep putting them in the bin and make sure you buy a parking ticket if parking in one of their carparks again or have a cordless angle grinder!

      • Mostly, yes. The only way they can force you to pay is by locking your car in behind the boom gates until you pay up. Even then, they probably wouldn't hold out for that long. Most shopping centres with restaurants or other venues attached will eventually open their boomgates after a certain time as they don't charge for parking after hours. You can just come back and collect your car then.

        The only exception seems to be university campuses. Not sure how it works, but they seem to have an agreement with the government to act as a debt collector on their behalf. If you park at a university without a permit, you can get a fine from the council which is enforced by the state. This happened to me many times at uni. The rangers always made a habit of conducting flash checks during exam periods where there are so many people coming to the campus at once, parking illegally is sometimes the only option.

    In NSW wheel clamping is illegal.

    No idea about other states.

  • Mum's house is in one of those apartment/townhouse estates with privately enforced parking, possibly by the same company. Had a few similar notices over the years, ignored every one. Neighbours did the same, and the "turning area" on our street was pretty much always filled with a couple of cars. Figured I'd have to really rack up a number before they'd make the effort to pursue, if they even could. Seems I was right, nothing ever happened.

    More recently, enforcement has been handed over to the council, which is a whole different game, but apparently one that was necessary because the old guys couldn't do anything

  • ABSOLUTELY CATEGORICALLY continue to ignore them. They cannot enforce this.

  • ring consumer affairs. it may not be legal for them to sue you at all. if not a road.

            • @Bobsob123: The ticket means as much as those notes that people leave on your car saying "don't park over my driveway". I've gotten many of those because apparently some people think they own the 10sqm space around their driveway, so any invasion of such space prompts a whinge.

              Save it for toilet paper if you want or just throw it away.

  • What are peoples thoughts. I unfortunately only came across all this info after I lodged a dispute.
    In my dispute I included photo's of my car in the car park.
    I am disputing it as they are saying I over stayed in a 1hour bay, however I have photo's to prove there are no signs indicating it is 1hr only.
    Am I buggered? They have reduced fine to $60. Do I just pay and avoid any further drama?

    • I got one too yesterday. TMS/Secure Parking must have convinced the owners of the lot to implement their scam. I just laughed at the ticket. Not going to pursue. Maybe I'll forward a copy to the council for lols.

      They used to operate in Carlingford before finally getting kicked out after 2 years.
