Advice Needed - Hit and Run (No Insurance)

Hi all, hoping to get some of your expertise to assist!

Last week, I came home to a note on my car from a witness, who saw a trailer accidentally scrape my vehicle which was parked outside my house. The note included details of the other car, rego, time etc - including the witness' details. I have cameras outside my property and everything adds up.

Now - the issue is that I don't have insurance. I called the local police station and they said they could make a report, but were not able to provide any details of the driver (privacy reasons). They advised me to contact my insurance company - however the car was not insured at the time (hadn't renewed).

Any advice and tips will be much appreciated!

P.S - fully accept that I should have had insurance!!

    As an uninsured car owner, you're pretty much stuffed.

    You need to get the drivers details, which can be done via the court system, but its a uphill battle and takes months.

    From there, you'll need to contact the driver to see if they own up to the fault, but by the time you get around to contacting them many months could have gone by so most likely they won't 'remember', showing them the video could jog their memory.

    The driver either didn't know they hit your car or they did. If they did, they basically won't be playing ball as they could have stopped and left their details already.

    So, If they want to play ball and have insurance, you can lodge a claim with them, if they don't want to play ball, you'll have to get your car repaired and try and seek money out of the driver, via letter of demand.

    Most likely that'll go unanswered as they're not playing ball, so its back to the courts again to try and get money, no chance of that happening straight away.

    Hint : court costs you money.

    So as I said above

    As an uninsured car owner, you're pretty much stuffed.

    How bad is the damage? You'll most likely by paying for fixing it yourself and it will most likely be 'cheaper' than trying all the above.

  • You knew this risk when you drove uninsured. Whether it was this, getting keyed, or some freak accident on the road, it's on you. Nothing to see here.

  • Why can't the police provide details of the driver?? I know if you have dash cam footage they will ring up the registered owner and pass details on

    How bad is the damage?

    As it’s uninsured you are on your own.

    You can:
    1. Try to chase the driver using the legal system.
    2. Suck it up and pay to get it repaired
    3. Suck it up and repair it yourself
    4. Suck it up and leave the damage unrepaired.
    5. Pay for insurance, wait a while and then try to claim the repairs - at risk of fraud and paying the excess for hit and run.

  • As I see it, people without insurance are exactly the type of people to do this. Having third party insurance may not be enough in this situation either. It's just the downside of trying to save money on insurance. Assuming the damage is mainly cosmetic I'd just leave it be - you may reach the same decision even if you had comprehensive insurance.

    The driver has committed an offence. You have evidence. You should ask the police to investigate the offence. You will get the offenders details if the driver is prosecuted.

    Some smash repairers have no fault repairs where they fix your car and let their lawyers deal with chasing the money. Maybe that would help you.
