Car Accident Advice (Both Drivers Sun Blinded - Who Is at Fault?)

I was stopped at a give way sign and proceeded through the intersection because there were no cars to give way to. Because of the shape of the road I needed to go through at about 15-20km, after I was halfway through the intersection I got sun blinded.

Just after that another car collided with mine at the passenger front corner (they came from my left side), both vehicles are now are wright off. The other driver admitted she was also sun blind. There are no Tyre marks on the road to show she had attempted to stop at all and I think she had to be speeding to hit me as hard as she did but can't prove it. When I looked at her licence she lived 10 houses down the street so she had just left her driveway so that would be why I didn't see her when I was checking the intersection.

    From the way this was written, it sounds like you want the sun to take liability.

    Either way, if you crossed the give way line and got hit at the intersection, you are at fault as it's your responsibility to check both sides.

    Sounds like the typical I stuffed up but want to try and shift the blame thread to me.

    You have pulled out from an intersection that wasn't clear, doesn't matter if she was speeding you should be able to judge that and take the appropriate action. I don't think they were speeding if they only lived 10 house up the road.

    Even if they did leave the driveway and gunned it, it will still take at least 10 seconds to reach you, plenty of time for you to clear the intersection if it was clear. I can't see how you are not 100% at fault.

    I need footage, from what was written it seems that the sun was blinding both drivers from different directions. The size of the intersection is a factor and you haven't even said the time of day or direction.

    I think in the end both drivers will end up paying their respective excess. At least you're insured…

  • If you are sun blinded and unsure if you can see a car coming due to the sun, you simply do not pull out. It's not the other drivers' fault that you played russian roulette just because the sun was in your face. If it's too difficult to make the right turn/straight on movement, turn left and find an alternate route.

        In OP's situation, as I said in my previous comment, they had the alternative where they could have turned left at the intersection and taken an alternative route which doesn't involve a risky turn due to a lack of vision.

    Insurance would say you are at fault as you didnt give way when going through an intersection that has a giveway sign.

    I can see that intersection is a poor place for a give way sign, but you are supposed to wait in the middle to check and give way to traffic on the other side as well.

    • This. I live in this area. And that is exactly what you are meant to do. There are trees in the median nature strip too and it’s hard to see. You can’t just scream or even meander through the intersection.

    If OP comes through a GIVE WAY sign and the other driver has no signage indicating they must give way then OP is clearly at fault.

    And OP just so you know, you cant blame the sun for your accident!

    Dude, you are doing the following:

    1) entering a main road from a feeder road
    2) crossing a give way sign to do #1

    Both of those things mean that you have to give way to a vehicle travelling on the main thoroughfare.

  • You failed to give way and caused a major accident, and are asking whose fault was that? Be glad that nobody was dead or seriously injured due to your reckless driving, because otherwise you will be in a prison.

  • The other driver shouldn’t of admitted to being sun blind at all. You’re at fault hands down. Sun blind or not; should of slowed down in the between lane gap to check your incoming traffic and to make sure it was safe to pass.
