Parking Fine in Loading Zone

My work has a loading zone . I have a new company car with no signage (at the time of offense). My car usually does have signage so I usually am able to park there . But because of new car and signage I voted fined .

I knew the council would not accept that the car was temporally with no courier signage. So I had a friend make up a breakdown invoice since he had his own mechanic business few years ago .
The invoice mechanic gave me was an old abn number that isn’t valid. So council wants to take me to court for lying on my appeal .

My question

Should I plead not guilty and have my mechanic as witness ?
Or should I just plead guilty and pay it?

If I go to court does the council have to give me a brief or evidence he has so I can prepare my case ?

Any advise ??

        He got busted breaking a 'rule' and went the wrong way about trying to get it cancelled, that's all.

        As for the OP, get some council letterhead and notice is that have an ABN or an ACN, being a corporation they should have an ACN but most of the have ABN's last time I looked. You might (if you're smart enough) bring that up in court as they are 'breaking the law' as well. Probably wont get you far as the courts are all part of the game but in the end you will have learned something.

          No he didn't break a rule, he committed fraud. A very well known judge was jailed a few years ago for similar actions in trying to get out of a speeding fine.

      Get your mechanic who no longer has his business to knock up an invoice. Get him to use his old ABN if possible.

      I mean to be fair - if I did something like this I'd probably create a new account just to make sure nothing can be associated to me. Other friends have found out I use this account so if I make stupid posts about the illegal activities I do I probably wouldn't want them to know.

    Definitely this is what you must do. The hole isn't deep enough yet. You'll both be imprisoned for perjury under oath. Free food and lodging and a criminal record. What a bargain.

    Looking at the rules, it doesn't matter whether it's a company signed car or not unless your business is transporting goods. If it's a vehicle designed for transporting goods (like a van or ute) you can park for up to 30 minutes. A commercial vehical like a courier or taxi can park for 15 minutes, and other vehicles can only drop off passangers. Times may vary between states, but Unless you drive a vehicle registered with the state as a commercial vehicle, your excuse of the car is normally signed doesn't really wash.

    Why on earth… Would you do that? It is fraud on your part and your "friends" part. They are likely going to be dragged into this and be fined as well…

    If the company you work for is an actual business(e.g. DHL) and you can indeed park there while going about your job. If they've given you the car to drive (I know large courier companies often use hire vans if they are short for whatever reason) then they could write a letter on company letterhead telling the council to go away. If you just do courier work and have a standard car that says "courier" on it then you still could try this tactic. Getting whoever you were picking goods up from to say "(you) were there at hh:mm on dd/mm/yyyy and write it on company letterhead" again possibly would have got you off.

    Instead, you chose to get someone to write you a dodgy invoice saying your new car broke down??

    • This. What do you mean you are going to court…on what grounds can council actually do this…did the council reissue the fine and you are contesting it, or have the police laid criminal charges for fraud?

      • Sounds like the council might have believed them but wanted to check with the mechanic in question. Maybe when their phone number on the invoice didn’t work, googling revealed the business had closed. Then they discovered the ABN had expired so they called the police.

    I would check exactly what you have signed so far. If you lied on an affidavit or formal court document, that's a serious matter that can and has been pursued, similar to judges getting others to cop their speeding points.

    Were you actually loading or unloading anything? A loading zone isn't free parking for people that have a business name on the side of their car.
