It was only a catalogue type thing with a bunch of their products that where on sale, first time I've ever received anything from them other than order confirmations and I unsubscribed from it in 10 seconds.

That's really not spamming. I got their email too, clicked 'unsubscribe', no problems.
In the email I received from them in relation to the offer when they did not supply the shirt:
[…]Let me know by reply email if you want to get emails from us about more free stuff, discounts and cool new releases.[…]
I never replied nor signed up to their list and they are using my email for commercial purposes without my permission so this IS SPAMMING.
