[Help] bought phone from qd Australia eBay. GST payable?

Hi guys,

I have bought a phone from quality deals Australia on 8/7 and on the listing it mentioned the item is located in regents park NSW. But I have just checked the DHL delivery notification, the item comes from Taiwan instead. So my question is

1) has quality deals register for gst with ATO? Turnover over $75000

2) if I get charge 10% gst at custom and I returned the item unopened back to the seller can I claim the 10% gst back? I couldn't find anything about this topic anywhere.

3) Can I report the misleading listing to eBay in this case?

Update 1: Thanks so much for the input. Sorry, I should have given more info about what did I bought, I got an Asus zenfone 5z which is $697 at the moment. So I would really like to know how they send the item to me, I have contacted them but no reply yet. And through the DHL tracking, the item is currently at Sydney and has cleared through Custom.

Now I will see how QD will sort this issue for me, and did Custom actually charge me the 10% GST. If yes, I will return the item back to QD and claim back my GST (Talked to my accountant it is ok to claim it back if I return the goods.)

Update 2: Got a reply from QD AU, they have mentioned their price has included GST, so we won't get charge any extra. I will wait and see once I got the device.

    A useful trick is to check the sellers profile. It'll say their real location as they can put anything they like in the listings.

  • Anyway don't worry so much as long the phone arrive well, you got it cheaper than locally. The shop is Taiwanese, better than Chinese.

    Regardless of whether the seller is excellent or poor, please report them to eBay. Sellers listed as local when they are not is really annoying.

    I returned my phone once for warranty.

    What did the seller say when you asked them?

    • still waiting for their reply (I sent the message to them 7am this morning). Anyway, based on the DHL tracking, it has cleared through Custom and currently at Sydney sorting facility. Should I expect they sent it as a gift and not held by custom?

    If the value of the item (plus any insurance) is over $1000 then yes, you will be charged Duty by Customs.
    If it is less than $1000, or you were charged GST in the eBay checkout, then no you will (should) not pay Duty on import.

      The OP is referring to the GERRY HARVEY GST on all goods under $1000.

      • Yeah and that new tax applies at purchase (to goods valued less than $1000AUD at participating overseas retailers), not at entry by customs.
        The only circumstance by which OP will pay duty is if the value is over $1000AUD (including any shipping insurance or extended warranty value) in which case, the OP would always have been charged Duty anyway, even for goods entering before July 1 2018…

  • It's still relatively new, so who knows for certain.

    But if it's under <$1000, I highly doubt it will be held at customs for GST as it is supposed to be the seller who collects GST.

    Honestly, the way I see it they're somewhat saving you money by listing it domestically otherwise you are definitely paying GST. Even though it's from taiwan, they usually arrive about as fast as stuff sent domestically. Apparently they have a great reputation for providing warranty services here in Australia, so I wouldn't worry.

    • I know the price is significantly lower. But it is pretty misleading for listing local and when I checked out eBay did not collect the GST. So should I assume QD already add GST on top?

      Another thing is that they said if they ran out of local stock, they will send it from overseas. This is very deceiving too when you first listing the item, shouldn't you already know how many devices you have locally? So when you are out of stock, you are out of stock.

      • The retailer is doing you a favour by listing the item location in Australia. You’ve a good chance of not being charged gst. You would’ve a zero chance of avoiding gst if they listed it as international.
