[QLD] Train Cancelled. Am I Entitled to Uber Ride Reimbursement?

While waiting for my usual 7:07 AM train (TransLink, South QLD) I heard an announcement claiming my train had been cancelled due to maintenance issues. I then had to wait for the 7:22 train to arrive which resulted in me missing my bus from the train station to TAFE.

I was pretty much forced into catching an Uber ride for $9.95 which my boss seems to think he shouldn’t have to pay for. Anyone had an experience with this/know if you can claim the Uber fare back from TransLink. At the end of the day $10 doesn’t exactly change much, but why should I have to pay for someone else’s screw up?

    I'll be honest, you're unlikely going to get re-imbursed and it isn't worth the time and resources trying to chase this up for both parties. Maintenance can happen out of the blue, and if they need to address this so suddenly unannounced, it suggests it could be for safety purposes. Unless you already specifically paid for a service that they specifically guaranteed say a scheduled flight/cruise, then you shouldn't deserve a reimbursement.

      Just imagine being halfway to your destination and having the train break down. Then you'd be even more screwed!

        Hell, I had this happen on my way to the airport once. The train broke down, I was delayed by two hours, missed my flight, the connecting flight, and the event I was flying to.

        I didn't have travel insurance, so I just dealt with it. These things happen.

    I would start with the local court. Get a good lawyer.

    No, you will not be reimbursed. There's a counter-argument to say it's your fault for leaving for the 7:07 and should have gotten one earlier to leave enough buffer time.

        • @Adz81: People take comfort and knowledge/advice from a variety of methods and people. A lot of posters may be younger generation that need pushing in the right direction. What may be obvious to some, isn't for others.

          You're entitled to your opinion by all means but it's best for someone to ask what to do with chest pains than sit there without asking…

The younger generation that you refer to have more access to information than ever before… It's not hard, even for the "younger generation" you refer to to direct themselves to an appropriate place to ask their question. The question itself may not be a stupid one, but the idea of asking it on a bargain hunting sure as shit is.

    Don't listen to others here. Go for it.

    File an application at the magistrstes court and get a decent lawyer. After you get laughed out of court, go down to the Supreme Court and file an application for hearing. You will need a better lawyer here. After they laugh at you and dismiss your claim, go to the High Court.

    All up about $200k to $300k in expenses but at least you have a shot at getting your $10 back

      On one condition though. You need to blog your journey and make sure you include every little detail regarding the court case coz I need the best entertainment value for my money!

    Did they have a contracted obligation to get you to tafe?

    The answers the same as whether you're entitled to reimbursement or not.

    I got stuck behind a firetruck the other day doing 60km in an 80km zone resulting in me being late to appointment. I should send a bill to the State fire service for the inconvenience and stress it caused me.

    There was a long queue for breakfast at Maccas which resulted in me being late. I should have asked Maccas to give me to the meal for free and pay for my Uber ride.

      In relation to the post for free passport photos, I think it’s more a case that the OP poorly worded what they are trying to achieve.
      The word "free seems to be the triggering point.
      It's entirely possible that there could have been a method to achieve free passport sized images.
      Perhaps a method that the majority of the general public is not aware of.
      Concluding that the OP is a "knob" for asking the question is perhaps a little short sighted.

    Reading this made me late for an appointment and I lost $10 as a result. OP should I send you my bsb and account details or do you prefer PayPal?

    On a serious note, can you imagine if people could claim refunds on late or cancelled trains in Sydney where there are issues somewhere on the network daily?

    Do you work at the TAFE, as you had said you had been going to TAFE.

    Anyhow, your boss is correct, he doesn't have to pay for your transport TO or FROM work, because you missed a connection.

    You didn't plan for any failures in the trip, this is public transport, you really need to.

    It happened to me once and I ended up walking. They reimbursed me for the wear and tear on my shoes.

    Give it a try and remember to report back on how you go! :)
