How to claim insurance for car damage?

I am hoping someone can guide me with car insurance claim as I have never lodged claim before.

I parked car as normal at train station's entrance street. When I returned I found a car parked illegally ahead of my car(see pic below).
https://files.ozbargain.com.au/upload/84336/57327/img_201803…

When I checked front bumper of my, it had small scratch at two places which this car would have put during reversing. I don't have any license details but got plate number. I took plenty of pictures before leaving the scene.

I am with Woolies and comprehensively insured. If I lodge claim, do I need to pay excess and can they pursue other party in absence of name and license details?

Thanks

Yes the car was selfishly parked to say the least, but can you prove that the Corolla did it though? Are there identical marks on the Corolla that support your case? Even then, the other owner can still argue that you could have caused the damage and turn it back on you instead. Without any actual evidence it's going to be hard to pin responsibility on the other party.

That guy is parked like a gaping sphincter.

Your evidence is circumstantial. It's your word against his/hers. They can incessantly deny fault and you won't get a cent.

But who is to say they didn't park over four nails that coincidentally happen to be on the four tires and found its way through the sidewalls. Hypothetically.

Ps. CCTV on building across the road, close to the gutter.

      good luck getting the footage..

You: hey someone hit my car
      Security: OK
You: You have a camera, can I view it.
      Security: -
      You: why are you silent?
Security: get off this property before i call the cops and charge you with trespass.

        Request it thru police

        • Know of anyone who does this? or has done this? the reality? police cannot barge into a business and demand you hand over things. Do you know who can make you do this? a Judge/magistrate. You might get luck and get someone who will help or the corolla that made the 2 scratches was related to a murder police have been investigating. So again, good luck with the CCTV. The reality is actually pretty disappointing.

But even if you did get the footage, whats it going to prove. (now we getting into legal arguments, save that for the Judge).

        • @tonsta:
          Location
          Sydney

Looks like we found the Corolla driver :)
Up to OP to weigh his/her options

      • I pointed the to CCTV for the hypothetical scenario. You're not going to see a micro collision from a CCTV at that distance.

        • +1

Yeah i know what you mean. My point was people get hung up on CCTV, people think just because a CCTV is in place they think they have a right to it.

The only right you have is to access "public" cameras but your gonna need FOI (freedom of information) request and good reason for it.

    • I'm not entirely sure the OP hasn't parked illegally.

NSW Road Rules … "You must not stop your vehicle (that is, bring it to a stop and either stay with the vehicle or leave it parked) in the following circumstances … Within 10 metres of an intersecting road at an intersection without traffic lights unless a sign allows you to park there".

      • Maybe he has but certainly parking with the nose of the car literally in the turning circle of turning traffic is worse.

In the face of a blackhole-esque rectum, being a little bit of an askhole isn't so bad.

  • I don't have any evidence apart from pictures.

Here is another picture showing how close he ended up stopping before he decided to park there.

    • It just shows he's a really good reverser parker? don't see anything wrong or damaging your car. Have you got anything else that can sway the Judge?

Call up your insurance, submit your evidence see what they say

  • re: the Corolla in front

You must not stop your vehicle (that is, bring it to a stop and either stay with the vehicle or leave it parked) in the following circumstances:
    - Within 1 metre of another vehicle parked in front or behind (does not apply when angle parking)

    the following possibly applies:
    - Within 10 metres of an intersecting road at an intersection without traffic lights unless a sign allows you to park there

    http://www.rms.nsw.gov.au/roads/safety-rules/road-rules/park…

    • Pretty sure the OP is within 10m of the intersection as well ;)

What i would like to no is how far was the car behind you. :/

Would of been a hassle to get out.

You have 2 small scratches… and never made a claim.. you have 2 small scratches…if i were you… keep it that way. Fix the damage and move on. You have 2 small scratches… i wouldnt fix it. You have 2 small scratches…just wait for that big accident you saved your insurance for.

If you claim, it will end in tears. Your insurance will jump up higher than the damage you sustained. No proof and lack of damage makes this a no claim situation.

    • I have what?

Small scratches on a $6k Territory… so not worth claiming. As above, wait for a good fender bender

    Oh, it's you

    • OP might consider selling the car, private transport is not suitable for everyone.

    • I took one look at those rims and wanted to vomit

When I returned I found a car parked illegally ahead of my car(see pic below).

You did find a illegal parker, and just quietly I think you're also too close to the intersection as well.

When I checked front bumper of my, it had small scratch at two places which this car would have put during reversing

No you found two marks that could have been there for hours/days/weeks. You're only looking as this car was parked so close. If they had already driven off before you got there, would you have noticed the marks? I doubt it.

If I lodge claim, do I need to pay excess and can they pursue other party in absence of name and license details?

If you lodge a claim, you will pay the excess. Someone parking 'close' to your car provides no proof they did the damage. So it'll be a at fault claim on you.

I mean in a later post you do say

I don't have any evidence apart from pictures.

and you are correct. You have no evidence. Maybe the damage was done the day before, maybe it was don't while food shopping weeks ago.

  • no pictures of the damage? Touchup Guys or similar should fix it ($200+).

  • Dang it. I'm gonna get a bullbar and a towbar for my Prius C. That ought to avoid these problems

    • scratch it while installing.. damn

      • Haha

You're both parked illegally. You should be 10 meters from the curb.

  • In madrid, parking like this is the norm

    • +2

And also opposite 39 Harris St, St Marys NSW 2760 by the looks of it

    • True dat. And Madrid is far more interesting than the industrial back blocks of St Mary's

    • In France its called parking by ear. You're supposed to leave the park brake off so people can push your car out of the way when the space is limited.

  • Woolworths is a big company. They’ve resources.

Did the OP research the Woolies insurance site or their policy documentation before asking here?

I would accept the OP making a request for opinions, on whether to claim, from Ozb wisdom machine. But…seriously…not knowing otherwise how to claim? It's readily provided with policy and the call centre is not that hard to hit up for some guidance too. They would likely advise same as here…no evidence..
You pay excess and your premium goes up…get it touched up and move on…

  • Fill in the claim form…OMG

Go to their web site and READ THE INSTRUCTIONS !!!!

Would you like me to hold your hand? poor thing

Pics of damage? At a guess, it's not worth making a claim, the excess will probably be more than the damage. Old car, insurance company will not be able to prove it was the other car - you'll pay, then keep paying more for having made a claim.

If you desperately want it fixed, get a tin of matching paint and DIY.

  • Thanks everyone. I will get it fixed privately.

    • Got a pic of the scratches?

  • you should push the toyota forward into the middle of the road, then call the police
