eBay requires proof of Signature On Delivery when return the wrong product.

I will try to keep it short.

I buy new iphone from my-phonez on Ebay (23/01). The seller sent the used iphone, I got it on 30/01. I brought the iphone to the Australia Post, told the person over counter that I want to send it back to sender. But there was misunderstanding so she put it in the box WITHOUT charging me, I asked and she said "It is already paid". One day after (01/02), that used iphone deliver to my home again, and I refuse to get it, I suppose it will post back to the seller. But up until now (14/02), the iphone still did not arrive the seller, it was "on the way" status.

I called Australia Post many times from 01/02 to 14/02 to make sure item on the way return to the seller. The Aus Post support open investigating case and told me to give the case reference number to the seller, told me that this is the issue between seller and Aus Post right now, and require seller to refund. I contacted the seller to get the refund, the seller said they will refund after getting the item.

I contacted Ebay to help on this case, the support team on Ebay requires me to show proof of Signature On Delivery on the receipt I post the item back. However, because I wasn't charged, and I refused the item on the second delivery, I did not have the receipt rather than the tracking number of the first delivery.

My question is: What should I do right now? I already made payment and it seems that the phone also lost on the way back to the sender.

EDIT: Sorry if it confusing
The receipt when I return the item has the same tracking number when the seller sent to me. I also made calls to Australia Post and ask them about the sender of this tracking number, it is clearly the seller.

  • So you bought new and they sent a used phone and messaged you and told you that before you received it? Might be a good idea to do a PayPal dispute for item not as described?

    • No, I bought new, they sent the iphone, but when I received and opened, it has some bubble on the cover, scratch on the cable and charger. At that time, I know it is already used and activated.

    You made a mistake. The phone back to you because you did not paid postage when you lodge at post office. So it is return to sender which is you! It wont go to seller address, they are not the sender.

    And now since you refused the parcel, this parcel most likely will go to australia post detention centre for lost parcels.

      Yep, this is what I took away from the post, but very confusing. When the phone turned up, the OP should have accepted it and attempted to return "properly", that is, confirm everything with the post office they felt suspicious about the first time.

      This is likely to be a drawn out affair for the OP.

      • Let me clarify the missing point:
        - When I brought the item with the package on the first delivery to the Australia Post on 31/01, the woman over the counter scan the bar code and said to me, "it is already paid" so I confuse the return process does not need to lodge a new postage, so no need to pay for the return.
        - The tracking number the woman gave me, is the same tracking number the seller gave me. Therefore in this case, the post office know who is the sender, who is the receiver.

        So when I receive the phone the second time (on 1/2), I refused the item because on the item and on the tracking site on Aus Post, it clearly state the sender is the seller, I was confident with that when I refuse the item.

          Problem is : the tracking barcode was the first time delivery to you. The lady are not supposed to scan that barcode, that is wrong.

          You need to send package back with a new tracking id.

          And now you will lose ebay and paypal dispute, since you failed to provide valid tracking id for returned products.

          You can not use original tracking id, that belong to the sender.

          I am afraid you are 100% lose now. Regardless seller sent incorrect phone to you or not.

          I just called Aus Post again, they said the return process I went through is correct, they also said I have the right to refuse the delivery the second time.

          @haisergeant: incorrect. You can not send / return parcels with the same delivery label / same tracking id.

          Unless the seller provided you prepaid return label, and the tracking id also will be different from original tracking id.

          Now you need to chase the parcel quickly or you will lose.

          I chased the Australia Post once again. What I got after the call:
          - They are investigating the item, with the original tracking number the seller sent. Because this item is insured, so if the item is lost/missing, the Australia Post will refund the seller.
          - They gave me the case reference number, told me I can send seller and Ebay this case number to have more information about this dispute.
          If Australia Post can find the item and deliver to the sender, Ebay will know and I will get refund.
          If Australia Post cannot find the item, the seller get payment from me and compensation from Aus Post.

          I called Aus Post at least 4 times today, but in the end, the Aus Post still investigate the item…

    Your post is really hard to understand…

    The big mistakes you made were

    1) Not getting a receipt saying you sent it back. The lodgement receipt is always printed. Doesn’t matter if it’s prepaid or not.

    2) Refusing delivery. This really makes no sense to me. So the driver came to your house tried to deliver it and you wouldn’t take it? Or they dropped a card in the letterbox ? Then you refused to get it wanting it to go back to the sender without paying?

    It’s probably now back your local post office , at the delivery center or somewhere in between. It seems to me that they possibly relised you didn’t pay at some point so they redirected it back to you as the sender.

    Have you checked your local PO for a parcel ?

    This is mostly your fault for not following the seller’s and eBay’s return procedure.

    • Let me answer your question:

      1. The receipt I got here is the tracking number, same of the first tracking number the seller sent me.
      2. The delivery driver come to me, I refused to get it back to the sender, on the tracking number, there is name and address of the sender (the seller)

      I know I have made mistake that I have to ask clearly the Post Office that I want to send it back to the sender, but it seems the Aus Post woman over the counter did not listen, so that causes confusion. I have been in Australia in short time, never return a product on Ebay, I do the return as the seller told me to do that, that's why I did not go through Ebay's return before having this problem.

      • If you got a receipt when you dropped it off then give that to eBay. All they’ll want is a lodgement receipt.

        As for 2. It’s probably ended up at the depo and now has gone somewhere. Unfortunately aus post struggles to track things within their own system. Let alone when someone refuses delivery. I can almost guarantee the contractor didn’t know wtf to do so they probably just left it in their van.

        As others have said the lady in the post office incorrectly scanned the original tracking number (presumably you used the original box to post it back?) said it’s been paid because the SELLER originally paid for it. Then somehow Aus post system let her rescan it, as far as aus post are concerned they are redelivering the item to you.

        Check your local po or the tracking and see if you can figure out what the delivery driver did with it…

        • I tried to call Aus Post, the answer I got is they are investigating, they need 8 days until Friday next week.

          If they find and deliver to the seller, I wonder Ebay will know it or not.
          If they declare item is missing/lost, seller got compensation. Will Ebay know it or not.
