your friend's
even the rubbish left behind belongs to your friend now
it depends on the contract. was it stipulated in the contract that the tools, painting, coins, etc, were to change ownership to the new owners of the property?
are you implying all those shirts, towel , bedsheets , quilt cover, forks, spoon, bowls, pot, pans, toaster, bulbs … that i found in my place, belongs to previous owner because they weren't specified in standard REA contract ?
is your friend's property in nsw and are the items valuable? if yes, then they may want to read this link.

This is not the case, anything found in the house after purchase or i should say settlement is considered abandoned by the previous owner, and now belongs to the new owner. Doesn't matter what the contract stipulates.
@whooah1979: What you have linked is not relevant in this situation, the first 2 links is for situations where delivery of the item is involved, the 3rd link is when people lived with you and was a room mate and left their items while moving out. They have nothing to do with the ops situation.
i can't find a link for nsw, but here is one for sa.

Generally your friend, but there have been a few court cases about people who forgot they buried tins of money, etc.
"Coins buried in the garden"
wtf?
Lol, he might wanna check what else is buried there… and why the owners suddenly sold the house leaving tools etc…
lol, I hope his last name isn't West or Fritzl.
Coppers are on the way
Considering that original owners can get away with broken ovens, A/C etc unless specified as 'working' in the contract, everything is your friends.
It may depend if your friend is Swiss.
metal detector. backyard. NOW!
Depending on what it is, it may be courteous to let the previous owner know they’ve left some stuff. It may have been inadvertent. Twice I’ve moved and asked the agent to check if some items left were meant to be, one was a front load washing machine, the other was some outdoor furniture that was ‘round the back’ and might have been missed in the move. Both times the previous owner didn’t want them.
Charge the previous owner rubbish removal fee if it was vacant possesion. If someone leaves stuff at your house I know the legal thing to do is to take it out as trash, the cops dont want anything to do with someone elses stuff.
