Buyer Paid Schedule Payment of $18500 for Next Day for My Car, but He Want The Car Today

Hi, I posted my car in Gumtree he agrees to pay me $18500 via bank but the payment is scheduled for tomorrow, but he wants car and paperwork right now. I am worried that payment didn't show up in my account, how can I give my car, he might cancel it anything.Until the amount show up in my account I am not willing to give my car.But he is putting a pressure on me that I am cheating him.

    Stand your ground, he gets the car when you see cleared funds sitting in your account. If he walks away, probably saved yourself a lot of heartache.

        Tell him go right ahead. A lot of them say that but by the time they do (if they even went to see a lawyer), the money would have been received and you can tell him to collect the car. If he told his story to a lawyer, they would have to refrain themselves from laughing.

      • The buyer is just nervous. Try to see it from his pov. He's paid you $18500 and is worried he won't get the car. This is why I sold my wife's car for cash. Try reassuring him as much as possible

        OP needs to transfer the money out of the account, and close the account.

        • Why? Your comment suggests that the cash payment can be reversed - so how does one reverse a cash payment to personal account?

        • @ATD: Buyer can just transfer the funds from a bank account that has been phished. The account holder will in a few days realise the missing money and ask the bank to reverse the transfer.

          Ever heard of those 'payment processor' jobs where you get money transferred to you, keep 5% then transfer the rest on via western union. It's basically the same situation. You do it for a couple of weeks then get a knock on the door from the police as you are getting money from stolen accounts transferred to you.

        • @bretto: Thanks for the reply - I just don't see it happening that way. Your example (which no doubt happens doesn't translate to this situation where you have a bona fide seller. The police showing up is an investigation concerning or in connection with illegal activity - nothing illegal going on with this seller.

          Once bank A transfers money to bank B, it is out of bank A's hands. To even start a request for bank A to see about having funds returned from bank B, the banks must first satisfy themselves that an error has occurred in relation to the transfer. There will be necessary checks and balances in operation. If you could just ring up and get money reversed that easily, the banking system would be in total disarray. Banks lose a lot of money each year through fraud - they wear the loss unless the owner of the bank account can be held at fault. Reversal of CC payments are easier in comparison.

          A smart seller will confirm the buyers details through their licence (required for a rego transfer anyway) and write up a sale agreement and keep a copy to evidence the transaction and date of ownership transfer.

      Police will say it is a civil matter. The most they will do is ask him to leave the property if that is what you want. You will need to tell them that your are concerned things could become violent and you fear for your safety. Police should talk some sense into him about what he is trying to do.

          Tell him to go wait on the footpath until the police arrive as he will be trespassing otherwise. That's something you can add to telling the police but as mentioned, they won't really be interested in it other than to move him along.

    As above stand your ground. You'll need to wait until Monday for the funds to clear as funds won't clear on a Sunday and then he gets the car.

    If he wants it sooner then ask him for cash not that it's easy to get that much on a Saturday afternoon.

        Its interesting he is hanging around knowing police will be showing if (when they do). Says a lot that he is suggesting you have any control over the transfer. Could be a huge misunderstanding on his part on how things work, but even so, I wouldn't hand anything over without $$ in my account. He sounds naive, but that wouldn't sway my position.

        • @Oz8argain: Easily!!! Cars depreciate like crazy in the first few years no matter how many km's you put on it. Plus the facelift came out already and this month or the next, the next gen camry comes out. So expect the price to go a little further down. Use carsales as an advice for how much the altise goes for.

      Don't take a bank transfer.

      Someone else will know the best way to handle this but I think a bank cheque is better.

        If you are the seller, bank transfer is fine BUT you must see the funds in your acount first.

        If you are a BUYER then NEVER pay using bank transfer because the chances of you getting your money back if something goes wrong is almost zero.

          If you can provide good evidence of the funds being legitimately earned, you keep funds , you will have to prove it to your bank , it won't be quick, but you will get them.

          @sprsl: No, the moment u bought the bank cheque from the bank they require you to have enough funds to issue the cheque. The money is deducted straight away from your account. It's different from personal cheque.

        I learnt recently when selling something, a bank. Bequest can be cancelled after it has been given to you.

        They are no longer recommended for this reason.

  • Any normal sane Buyer knows they are not going to get the car until the money clears, anyone thats starts demanding strange things like taking a car that hasnt been paid for is clearly deranged and is a scammer.

      I once sold a car with face-to-face meet and on the spot transfer. If it's the same banking institution (ours was CBA) the funds clear immediately, which it did and car was taken immediately.

      Yeah. If the buyer is legit then he didn't think this though. He should have gone to his bank with OP and withdrew it all as cash if he absolutely needed the car that same day.

    I slightly damaged a guy's car door in a parking lot when he opened his door right at the moment I was pushing a trolley past his car. The damage was very minor, but the driver was having a hissy fit about it. He said he wanted to call the police (wtf!) and have them attend the scene. I said go right ahead, and provided him the 131444 number. I was thinking of being nasty and saying 'okay, call 000' but refrained.

    He actually called the police and they told him where to go: to his insurance company. The damage to his door cost a whopping $120 to fix, and he called the police over it.

    So, when someone wants to "call the police" to pressure you to do something, and you're in the right, go right ahead and have them call. If they threaten to sue you, say you'll be waiting for a letter from their lawyer. Stand your ground to ridiculous bullies who want to use the police or fictional lawyers to intimidate you.

      It sounds like he damaged his own car door. If you were on a bike in the same situation, it would still be his fault afaik.
