Hi
I live in an apartment and a leakage in common area caused damage to floating flooring in my room.
An agency is responsible for managing the common areas of the building. They delayed in fixing the leakage which resulted in damage.
I'm curious who should be responsible for this damage due cause by something else.
Should I be paying for it , the agency or it should be taken as some ratio from everyone since it was due to issue originating from common area.
Also : I don't have my place insured and hence the question
TIA

The body corporate should be paying for it, either via their insurer or from the pool of funds (which means you may have to indirectly pay a % of it).
This is what I thought as well
Depends on the source of the leak, if it's a leak from pipe/wall in common area into common area then yes it's strata/body corporate responsibility.
If the leak is from yours or another apartment then the owner is responsible.
I had a chat with body corporate earlier and they refused to budge. What should I do now ?
Also while looking online I found this and hence thought of asking here
http://www.fairtrading.nsw.gov.au/Tenants_and_home_owners/St…What is their rationale for not aknowledging this is their cause? Do they have proof the other way or do you lack proof of your own?
I think because of leakage my first aim was to get that fixed. Since they were taking too much time in fixing that I warned them than I'll go to the tribunal if they dont fix the issue (since it was causing problems for me) and they replied that I can go on and they know their rights.
Don't budge on this, if its consequential damage from an issue emanating from common area, then they're responsible for fixing it. They may come back with crap like your home/contents insurance should cover the damage, their insurance doesn't cover carpet, etc.. At the end of the day, "they" caused the damage, so they need to fix it.
The owners corporation is responsible.
Even if it is a floating floor ?
Damage to your possessions due to water ingress from common property is owners corporations responsibility.
Thanks Everyone..
Seems like things worked out..I dropped couple of emails and they are asking me pics.
Talk to your strata manager about it.
