Breaking Contract for NBN without penalty

Hi, guys, I was wondering how or if it would be possible to break an NBN sign up contract 12 months

I was thinking if the speeds were inadequate or the service was crap would that be a decent enough reason to be released without penalties?

I'm not sure if anyone out there has gone through this and what happened but it would be decent to know.

From what I've read, if I'm not getting the service I paid for it should be simple to get out of a contract due to exactly that.

    I broke a NBN contract with TPG after 2 phone calls, even got the 30day notice period waived.

    Just have solid justification and examples to provide them with. Use the TIO as a escalation point if required. (Don’t threaten TIO from the beginning as this puts them on the defensive)

    • To further this - I find simply asking for supports help works well the majority of the time. "I'm having this problem, I've been told it can't be solved in a reasonable time frame - can you help me end my contract early without any fees?".

      The only time I've ever seen companies deny this kind of request is when there's multiple companies involved and fingers can be pointed, ie if you purchase a phone from a franchised Telstra store. Telstra points at the store, the store says to to Telstra, etc.

    If you have a legitimate complaint, your first step is to ask your provider to fix the problem. If they don't or can't, your next step is the TIO. You need to ask your provider for a complaint number to do that, though.

    On your TIO complaint, you specify what the problem is, and what your desired outcome is. In your case, that'd be something like you wanting to break the contract without penalty because the provider is not giving you what you're paying for.

    You may not need to go as far as the TIO - sometimes, the provider will let you out of the contract if they can't or won't fix the problem and you tell them that you'll lodge a complaint with the TIO.

  • Two more things to note:
    First, Changing ISP might not make any difference to what you're getting. Depends on where the issue lies.

    Second, Make sure that if you go TIO you actually know what you are agreeing to. I used to work for an ISP, and the amount of people who would come to see me after going to the TIO and not before was baffling. It wasn't that I was unwilling to help, it was that I was unable. You will be assigned a case officer by TIO, and you may not contact anyone else at the ISP about the issue while the case is open.

  • Just tell them your moving house, and pick an address that NBN is not yet active in.

    If they cant service you, then they are breaking the contract. If they try get you to downgrade to adsl or something, tell them the premises already has internet (moving back home with parents) or something along those lines :)
