  • Thought I had scored the xbox.

    Checked out via PayPal and it's been showing the 'processing' icon with the circle around the padlock for well over 5 minutes.

    Looks like I'll have to click the cancel option.

  • Went all the way through, didnt say ' sold out ' when I first clicked it.

    Had all paypal details saved, click go without confirming the 'total amount' (lets be honest, its all about speed) and the Xbox had changed into a dummy product with about 20 numbers as the product name, with a total price of 0.45cents + 0.5cents GST.

    clicked proceed anyway, sure enough paypal charged me the 0.50 cents.

    Just cancelled it via paypal.

    • Managed to snag one of these. There seems to have been good supply of them perhaps 50 odd based on my order number and the order number of a friend. You have to be really quick.

    I would imagine that I am not alone in being annoyed with the bait style advertising Clickfrenzy is conducting.

    I have already sent Global Marketplace (Clickfrenzy) an email this morning regarding these time and category specials. I believe they are conducting false and misleading advertising by failing to either disclose the number available or to provide sufficient stock to meet the expected demand. It is in sufficient to simply state "Only while stocks last." See Australian Consumer Law section 35. (See https://www.accc.gov.au/consumers/misleading-claims-advertis…) It is a form of bait advertising, with the objective to have people use their website and talk about the amazing specials on offer.

    If the emails and other advertising had even stated that these offers are in "short supply", it may have been acceptable. However, I think the issue goes even further than that. If there are only say 5 notebooks on offer, then clearly they never had any intention of meeting the demand. Thus the offer is not genuine sale offer, but a competition. In which case a whole different set of laws would have applied. The advertising would need to have made it clear that it was a competition and there are different regulations that apply.

    Later today I will draft up a form letter for to submit to the ACCC. For the adventurous playing along at home, I intend to take this issue to QCAT which will cost Global Marketplace around $500 in tribunal fees. Plus of course any addition costs they are likely to incur.

      Totally agree - it is a competition pure and simple and should have been registered as such.

      • Not sure whether it needs to be registered or not. If indeed it is a competition, it is definitely one of skill and not chance. Quick fingers or bot programming ability seems to be the skill.

    • Good points. I think most are only accepting of this promotion only if treated as a competition (in which case quantities should be disclosed in T&Cs, they aren't). If treated as a item on sale (which they are given the transaction needed to claim) then reasonable quantities should be available. Even Aldi could argue they have 15 TVs per store and perhaps 50 customers line up at opening clamouring for one but the odds here are way skewed against "customers" let alone having selected an item and losing it in the purchase transaction. That's like a staff member taking your TV from your hands at the register saying you can't have it now because someone else does! ;-S

      Ultimately people just want transparency/honesty rather than being baited and feeling they had little or no chance in the first place even if they participated fully.

    • People complain about it every time Click Frenzy runs this. People report them to the ACCC. The promotions keep happening so reporting them does nothing.

  • Think there were about 5+ ozbargainers who reportedthat they scored the $100 gift card in last year's forum. They probably have even less stock available this year.

    • Last year I got the gift card and an Xbox. This year is on a new a level for non gift-card items in terms of competitiveness. I got my gift card this year and I'm done.

      If they wanted to infuriate customers less they could just put a link up for an entry form for a short period during the hour from the link then just draw a winner(s) from that pool of entries. Of course it would be treated honestly then as a competition which it effectively is in reality rather than an item for "sale".

          There is definitely cheating going on and I suspect automation or robots. I know CF is not a scam because I won an Xbox in the last competition. This year I don't believe it is possible for a human to react as quickly as what I am seeing. It's a pity that a few greedy individuals ruin it for everyone. They no doubt have multiple accounts/addresses and will probably sell their prizes on eBay etc.

      you wont get many tips here, there's fierce competition. As a point of rule, only refresh as fast as your internet connection allows.

        They were so paranoid that they started adjusting the web pages placing fake products into the mix which they actually sold. = Illegal

        if you have Auto refresh running if it refreshes the item page and you did get through it took you to one of the fakes. = Cheat

    • Did it last year and didn't win anything. Not doing it this year, but I honestly thing it is not an even playing field. If the winners aren't using scripts or something, then I reckon (and I have know knowledge if this is even technically correct/possible) it is something like people with the fastest internet or on the same provider of the website…they probably get the banner a few seconds faster than everyone else or something.
