Volkswagen Dieselgate Class Action - Legal choices

Hi,

Unfortunately we own one of the affected vehicles and are just about to enter the class action against VW Australia.

Can anyone comment on the pros and cons for the two legal companies pursuing this case.

If I understand correctly, Bannister Law where the first to launch an action however Maurice Blackburn seem to be more experienced in class actions.

I'd appreciate any comments you have on choosing.

      Wasn't it just a case of fudged emission figures? Does it really have any outcome on individuals? What would an individual claim as damages?

        They are all going to say they care about the planet and only bought the cars because of the low emissions. Now how can they live with themselves?

          I wake up at night in cold sweats thinking about how my emissions could have caused the world to end.

        • I was looking at upgrading and to be honest, diesel was a consideration based upon the marketing. After I did some research, I found that diesel is still dirty regardless in terms of emissions when compared to petrol. But the VW advertising certainly did work initially.

    Perhaps you should do some more research.

    • Perhaps Maurice Blackburn need to update their website.

    • Both statements could be correct - for example, Bannister's claim might only have named the Australian distributors, dealer network…?

    • Perhaps you should learn to comprehend English.

    sigh I wish I owned one of the affected cars so I could pretend to care and possibly make some easy money from suing VW.

    I bet 99% of owners knew nothing about the emissions until this story came out.

      But if I had a VW I'd be OUTRAGED! because I know that it'd cost me millions in resale. I'd feel like I should just push it to a scrap dealer, I couldn't drive it for fear of dying from fumes.

  • Whatever you do, don't get the software update from VW as it may lower your engine output and is not reversible.

    If I had a diesel, I'll probably join the class action to teach VW a lesson, but more so to get a few $.

    I own a VW Golf GTI, so petrol and therefore get nothing.

    End of the day it's a cash grab against a large profitable company so no one is going to feel bad about suing them.

    To get a definitive answer why not just telephone both law firms and ask what class actions they've been involved in?

    Maurice Blackburn's wikipedia page mentions a few major cases involving class action.

    I've never been involved in a class action but these class action lawyer fees seem awfully like a regular lawyers fees. If I'm paying the same for a regular lawyer I'd be expecting my case to be personally attended to!

  • As far as I understand it. The Maurice Blackburn class action is an inclusive class action. Therefore it encompasses anyone who has an affected vehicle.

    If you sign up they can potentially argue your individual circumstances and give you more updates. However, the compensation, if any, will be the same. Except MB will deduct their fee from your share if you signed up with them.

    Please correct me if i am wrong.
