Moral Dilemma, with a Neighbour Who Is Breeding puppies

Ok so the short story is we have moved into this house we bought an year ago, and the neighbour is divorcee with 3 sons who work as tradies. He has 3 big dogs 2 Dobermans and a Rothweiler with poor socialisation. As they bark at everything that moves past their house and they are a corner house. He does backyard breeding how do we complain without them knowing that we have done it.

And the long story is, when we moved in I went introduced myself, as I wanted to talk about replacing our boundary fence we share with them as it was in a very bad state. He was very cold and reluctant to talk at first, however after a couple of tries he agreed and asked me to get some quotes. So I did, get 3 quotes for timber fence, however once I went and got them he completely changed his view and said he wanted to go the colorbond way and his sons can build it at the same cost. I reluctantly agreed, he said he had some money issues and can only get it done around Sep 2016. Weeks passed, months passed and could not contact him as there is no access to his house with the crazy dogs. Tried contacting his tradie sons to no avail.

In the meanwhile he atleast had 3 litters we know of all from the same Doberman female in the 12 months we have been in the house. Me and my wife contemplated a number of times whether to complain to the council about the noise of the dogs or to RSPCA about his backyard breading, however we resisted for 2 reasons. One was we went and got a Germnan Shephard puppy of our own so weren't sure how noisy our own dog would be and also didn't want him to turn hostile if he found out that we were the ones who complained.

So its been more than a year since I spoke to him about the fence, lost any hope that he would pay his half for the fence, so basically when we can afford we will just have to fork it all ourselves. Now with the dogs and his backyard breeding what do you guys think we should do. I still do not want him to find out we were the cause of shutting down his puppy factory if actually somebody does take action…

    Replace the fence, put a copy of the invoice with your bank details attached asking him to pay half. If he doesn't, take him to court.

    As for the dogs, if you think they are being grossly mistreated, call up the rspc and share your concerns. If you're worried this may invite retribution from the guy, perhaps investing in security cameras would be good idea.

    • Thanks @outlander, putting a copy of the invoice sounds like a good idea, have to see how he reacts as he did say once he has a few court cases pending from his ex-wife he was busy with.

      That ain't going to work.

      Good luck getting him to reimburse you after he didn't authorise for the fence to be replaced.

      You think the fencing contractors are going to start working on the fence with 3 poorly socialised dogs?

      • You raise a good point. Definitely tricker to pull down a fence and replace it if their are vicious animals behind it. Guess it depends on how confident you are dealing with dogs.

        The fence has been described as being 'in a bad state', but I suppose we can assume that it is sufficient enough to stop these dogs from getting in the OP's yard. But if its in a bad state, it doesn't take much to change that. Maybe a fence paling falls off once day. Enough that one of the dogs could squeeze through.

        At that point it becomes a dangerous situation, and the police can be involved. It's probably preferable if it doesn't go this way, but I'm just saying, you do have options.

      If he doesn't, take him to court.

      And get laughed out of there. Next case!

    IMO treat the dog issue and the fence issue seperatly.

    In Vic you cannot replace a boundary fence without the consent of your boundary neighbour. The law on this changed last year I think it was or maybe 2015. Consult the online law handbook from Fitzroy legal service for fencing disputes as it will be better and more accurate than the info on ozbargain, including mine.

    Unfortunately, anyone is allowed to breed dogs and sell them, so you're not going to have much luck there.

    Unless they are breaching (very lax) animal welfare rules, they can keep doing it. And even if they are they'll likely just get a fine and can keep going.

    Its completely stupid and needs to be stopped. Until every animal shelter is empty and no dog is going uncared for (aka being put down because it wasn't rehomed within a timeframe), spaying should be mandatory and selling animals illegal. But what would I know, I'm a leftie wingnut :/

    • I have not trouble with registered breeders, but they need to be able to prove the animals are being treated properly and are well socialised. I would, at least, talk to the RSPCA and see what they think of the situation. They actually have some pretty extensive powers to go onto properties where animals might be being maltreated. If nothing else it will salve your conscience.

      As to the fence, it can be a problem if the neighbours are recalicitrant. I would make sure his dogs can't get through.

      • I will try speaking to RSPCA as the council has been hopeless.. tried speaking to them when we first moved in and they were least concerned

          The councillors are too busy going on study trips and getting "donations" from people building inappropriate apartment blocks (vertical slums). :)

    http://www.disputes.vic.gov.au/fences-faqs tells you all that you need about getting a Notice to Fence, and then having a go at recouping half of the cost.

    It's ridiculous that people are allowed to keep animals that bark throughout the day or night.

      My next door neighbours are a large, feral family. Lots of kids.. noisy shitheads. They're also fat so whenever they run in their rickety floorboard home, it thud thud thud thuds and I can feel it vibrate my own floor.

      The mother is a loud mooing cow. She yells at the children from inside the house while they're out in their big backyard.

      I didn't think it'd get much worse.

      Then they got this tiny itsy bitsy dog. Pomeranian pup. Quiet as a mouse.

      But these feral kids now bark AT the dog. Day through to night. Barking humans.

    I'm not clear on what the problem is?
    Is it you are hoping to replace the fence soon and have him pay half? If so, it seems that he is not flush with cash so might have other priorities. Assuming the fence is functional, which it sounds like it is as you have not mentioned escaped dogs, then you might have to wait until he is ready, or if you are in a hurry, pay the whole cost yourself.

    I'm also not sure what the breeding issue is? Is it that the dogs are noisy, or mistreated or what?
    Since you started with the fence issue, I will assume that the dogs are not the main issue, just something you are disapproving of. Has the neighbour complained about your dog?

    • There are 2 problems, his dogs and the fence which is rotting away and has some big gaps in some places. So I have waited for an year.. His dogs and the litter are noisy as I mentioned and no my dog isn't noisy.. :)

  • Even if you sort out these two issues, it's not going to stop there. More stuff will come up.

    It sounds like you moved into the wrong neighbourhood. Your best option may be to start looking at moving house. It may prove less stressful in the long run.
