Recent EB Games sale sending damaged & second hand stock to OzBargainers as new condition. Recourse?

Just wanted to bring to the attention of the OZB community of a recent EB Games sale where I believe EB Games has deceived many of us. The games were advertised as being new, but all of the games I have received so far have been in opened or non original boxes with varying degrees of damaged manuals (eg. coffee stain over the Lost Planet 3 serial, torn Shogun 2 manual). So far all the CD keys I put into Steam worked (only to test that I didn't receive used keys). I intended to use some of those as gifts but there's no way I could have gifted them in their condition.

In addition they are sending each game as a separate delivery (I bought many) through Star Trak who won't even ring the bell - but just put in a card that it's ready to pick up at the Post Office. Then I go to the post office (even have to pay for parking in my area) and the staff tells me that he hasn't come to do the rounds yet, despite going hours after card said it would be waiting at the post office. This happens multiple times per day.

Here I was expecting 2x deliveries of new games (as per the order confirmation), and it's looking more like I will be getting about 30 staggered deliveries of damaged stock.

I'm in half a mind to call up EB to cancel the rest of my order and request a refund. It's a bit of a shambles.

    You should definitely get a refund.

    DSE got in a lot of trouble for selling returned items that had been used. I think a USB hard drive with some images on it was the straw that broke the back. After that anything returned or repaired had a big label on it indicating as such.

  • i placed an order for about 20 games.

    i got calls from different stores mentioned the condition of the game or what was missing. I didn't mind as i had paid only a 1$ a title, considering they were posting the game out with a courier. the postage costs alone is already a bargain. If you not happy with it take it back for a refund, not sure if they take back PC games though.

      I didn't get any calls or emails - just confirmation of my 2 shipments after placing the order. I think that if they were advertised as $1 in new condition, that they should have been in new condition. Most if not all my titles were $4 (+shipping), not that it's much more than $1 - but even if I only paid $1 and it said they were new, then I expect new.

      Also I don't consider it a bargain to have 20+ orders delivered staggered when I have to spend 15 minutes and a few dollars to pick them up from the post office when they don't leave it in my secure mailroom in my apartment complex or even bothered to get the building manager to sign for them and hold them in a secure area for me (standard practise in modern apartment buildings).

      I consider that a bargain for them as they are sending couriers all the time anyway, it would be more effort for them to actually pack my order rather than send things off piecemeal with the other orders.

      I now have to also go through and mark off each one, one by one on my order and chase up individual ones over time rather than just get the 2 deliveries (as was on my order form).

      I'm leaning towards making a Pay Pal claim as I paid through that for new items and received damaged old stock.

    Got my stock too, 3 items I bought was apparently not in stock anymore when I definitely bought it when it was. 1 item I got was preowned when I chose new (they were same price though). A magazine I got came in a massive box with 2 eb games bags in it that contained air taped up, with all that packaging the magazine arrived broken (ripped front) which was likely the case due to being ripped before delivery.

    I know I didn't pay much for these, but I'm surprised to see ebgames be such a joke about it, makes me worried if I ever buy more expensive games from them that they'll just jip me out.

  • I'd try resolving the issue with the retailer first. If can't get satisfactory resolution, tell them that you'd want this to be escalated. I'm pretty sure Fair Trading has a strict view of selling used goods as new.

  • This sale was not done well as i can relate to everyones annoyance. I ordered around 15 items with 5 of them canceled after they had sent a majority of items giving a low chance trying to cancel the order.

    Had no idea that items would be sent separately through startrack; who are lazy in my area sometimes and do not deliver, so had to pick up over 10 separate oversized bulky parcels from my local post office. Seriously boxes 5x the size of the item inside. Some items from the same store sent at the same time were still sent in different boxes. Some items appeared store worn/damaged, which is not good for art books.

    Today received an extra package with a duplicate $4 item and an empty box for a $57 mouse i did not order which i think they may of used for padding but that just makes it more confusing. Yep this sale was a mess but i admit some good deals if you could get them and ignore the major annoyances.

  • I got a full refund a few days ago and I keep getting dispatch messages and parcels showing up at my door.

  • They also sent all my games individually via Star Track. I've had like 10 parcels so far, even huge boxes that could hold 20-30 games for a single game. All were unsealed but that's to be expected as EB sells all "new games" unsealed off the store shelf. The weirdest thing was I got sent a $19 gift card in a brown envelope with no note or receipt telling what it was for. I'm still waiting on some games to arrive so I assume it's one of them but it's bizarre that they would refund me via a gift card. I have no plans to buy anything from EB in the foreseeable future… Why don't they just refund the money to my credit card? I tried contacting them last week but received no response.

    EB must be losing money on this. Sending $1 and $4 items via courier with full tracking would cost them a lot. If I knew it was going to be like this I wouldn't have bothered. Going to the post office to pick them up every day is too much effort for a few cheap games.
