NSW Drivers Licence - legalities around!

Greeting OzBargainers!

I bought a flip wallet for my IPhone the other day (was reduced from $35 to $10). The wallet that is!!

The wallet has internal storage for 2 credit cards - thinking of debit card plus mediscare card here.

Just wondering if it is legal (in NSW) to carry a picture of your drivers licence as a picture on your phone rather than drive around with it?

That way I could carry the 2 cards I am thinking of having with me.

Hope I am making sense?

    Of course not. lol

    The police would fine you on the spot if they caught you doing that.
    The only other acceptable form of a licence is a temporary paper driver licence receipt.

      don't let this post scare you though, the fine is $44 from memory when I left mine at home and got breath tested. It's driving without an actual valid license that is in the RMS system that is really costly.

      edit: no demerit points and was last year.

        • I have been pulled up a few times without my wallet, and have never been stung for not carrying my license, I do always offer my number as I have memorised this and they check my info on the computer, but even when stung for something they haven't bothered including that pithy extra fine

          unlucky, also helps because I was coming home from nightshift at work and not a P plater. Didn't want to hurt my wage he said.

        I remember in the past you could go home, and find your wallet to show the police at a station with in 24hrs, no fine.

        Are they that short on cash, some been counter nutter changed the rules?

          You gave a good point, government is trying to make Police relies on it's own when it comes to funding, and fines are the best!

        • These days it's a copper on every corner waiting to book you crossing the street wrong. Over policing at its finest.

        • @BargainKen: I took a picture of a cop crossing the road when the pedestrian light was red, I'll pull it out and show it to them if they try to fine me for doing the Same. I haven't been caught jaywalking yet though ;)

      yet, if you dont own a licence, and the police want to validate your ID, they can look it up on their computer instantly.

      even if you had a licence you left at home, they could look it up on their internal systems, see a picture, look at you, ask a few
      questions and validate you instantly.

      Why are the cops in 1956, they have technology to validate you without any physical id cards.

      And its perfectly legal to have a 'copy' of your licence as a reference/backup (everyone should have copies of all ids), which the cops can lookup in 3 seconds on the computer.

        I think you're right, but they will most likely ask you why you left it at home. I don't think everyone is comfortable lying to the police by saying "I forgot it".

    Op, you're in nsw. You don't need to have a driver licence while driving.

          In victoria, you can produce your license at a police station within 7 days if you can give a 'reasonable excuse'

          Provided your over 26, been licensed to drive for more than 3 years, and not driving a bus truck or towing a trailer

        i'm in brisbane and was stopped by police at 4.30am for breath test on the way to work. no licence. no fine.

          Yes, I've always had to have the card with me, no card, I'd have to pay.

          The only exception is when I wasn't sent a new card before it expired. I had the old/expired with me with the number however so they had to phone in to make sure I was still in the system until my new card arrived.

        you can download medicare app via your phone and can show your virtual card from there (take the screenshot) and you have your medicare card on your phone

      The Medicare express app has the card in the "wallet" section. Or turn the phone sideways and it appears. Any place should accept it. Where I work we have been told to accept them.

      • +1 this is what I do too. A debit card, plus licence. I have nfc, hahaha, so I use that for most payments anyways. If you're with nab, then get their little apple pay sticker.

      Photo of it should be fine, or use the medicare app.
      Practices you've been to previously should have your details.
      New practices - just call ahead and double check.

  • I don't know if its true but I heard that in South Aus as long as you can remember your drivers license number (and have some sort of photo ID maybe?) then you're fine. I have NO IDEA if thats true (and I doubt it is) but I'd imagine you could grab the license number from the photo. Also all states are different so who knows.

    To be honest I think only transport NSW would know the truth (and I'd imagine police would still give you grief over it). Don't know if helpful but I usually put my metro card inside my case between the phone and case (so like its wedged in the middle between the back of phone and case). Since you hopefully won't be using it much it will hopefully be alright?

      Right, so you only have to carry it when driving.

      Personally I just leave my licence in my car glove box. I rarely drive other cars and it makes my wallet more streamlined.

      I rarely rarely ever need to show my ID, but maybe because I don't drink or smoke.

      Pretty much the only other times you would be asked to show your licence are if you:

      • check in at a hotel/hostel
      • buy alcohol or go to a bar/club
      • buy cigarettes
      • buy knives or spray paint
      • check in in-person for a domestic flight (but you don't need it for a web check in!)
      • withdraw money in-person at a bank branch
      • some health appointments, like donating blood
      • pick up a delivery or online order at the post office or Colsworths

      I'm sure there are a few others, but my point is that if you don't drink or smoke then you very rarely need to have your licence on you. And on the occasion I do need my licence, I will usually have my car with me so I just go back to the car and get it.

          A replacement in QLD is about $75. I have better things to worry about, and it's $75 that's probably covered by most car insurance policies anyway.

        • @inherentchoice: Do you have house keys or a garage door remote in your car? The thieves would then have your car, your main form of ID - with your address on it, and a way to get into your house.

          @macrocephalic: Good point. But no house keys or garage remote. Still, I think I will move it from the glove box to the fuse box (under the steering column). Doubt thieves would look there.

    Download the medicare app and if you flip to the landscape view, there's a virtual copy of your card.

          I am too old now (early 40s) but even as a teen or 20-something I didn't get it. Watch a bunch of sloppy drunks dance in a smokey environment and get wasted while often hooking up with randoms and posers, to the background sound of awful music turned up so loud you can't hear yourself think let alone have a conversation. I mean it's amusing to watch once or twice but it gets old quick. It doesn't help that I don't drink. Mostly because alcohol and my taste buds don't along. And even when I was single I'd never want to pick up a girl in a club.

        When something says you need "IT" - it means you need "IT". Pretty clear that a copy of it does not satisfy the requirements.

    In WA, you don't need to carry it. However if stopped, you just need to bring it in to the local cop shop within 24hrs or so.

  • So you need to carry it, you also need to ensure that someone else driving your car is licensed. Other than seeing a licence is there any way of checking if it is current, like with the rego check app?

    A few years ago my licence was suspended for being a naughty boy, but I carried the physical card with me for the period of suspension. I could have shown that to anyone as a 'valid' licence. If someone comes to test drive my car for sale, can I get proof of their licence being current?

  • as of 1st march this year, NSW cyclists are required to carry some ID with them (in case of accidents) and having a photo of your license on your phone is considered fine.

      Nope, the cyclist carrying thing didn't get passed. They are still considering it for next year though.

          It has been in forever. Fines just went up in March.

    I have my physical license and a $50 note jammed between the back of my phone case and the cover. (not a special case)
    I have the phone pay credit card app so technically don't need my physical CC. That said it doesn't work everywhere, or all the time, but I often leave my wallet at home. If I'm planning on buying something then obviously I take my wallet but most of my purchases are online these days (and a chunk courtesy of this bloody place :P )

    • My medicare card expired and I didn't even know, and apparently they don't automatically send you a new one nowadays unless you request it? Anyways hopefully I don't need the doctor for another 10 years.

        I tried activating a phone with my Medicare card, it didnt work, why not?

        They had just sent me my new card where the digits at the end change. (It was still in the post so I had no idea it had changed and I never requested it, and my old card still had a month to run)

        Maybe you didnt get a new one because you used it so much or didn't ? Or maybe you voted wrong? However you are in QLD so they probably thought you had already seceded 😀
