Scorptec Romoss Sailing 4 Reasonable Lifetime ACL Dispute

Last year in late March I bought a Romoss Sailing 4 for $39 (normally $69) from Scorptec. It always had a wiggly micro-usb charge connector and not a positive action like my other devices. In hindsight I should have immediately filed a warranty claim but I did not.

However a month back (little over a year from purchase) the micro-USB connector completely failed the ghost and now even if you wiggle it fails to charge except if you put it precisely in a particular spot and even then it fails to charge consistently.

I contacted Scorptec a month back and they initially declined the warranty return due to out of 1 year warranty. I rang up and disputed and they agreed it was covered under the ACL and would replace the power bank. However they have since reneged on that promise.

Now according to Australian Consumer Law (ACL) a product should last a reasonable amount of time. It doesn't define reasonable though. To my way of thinking reasonable is 2 - 3 years but you may differ.

So to answer the poll how long is a reasonable period of time?

And what are my options in regards to getting a replacement? I'm fine with that and not seeking a refund because besides this small problem I've been most satified with my purchase. Do I complain to Victoria Fair Trading since Scorptec is based in Melbourne or Queensland since that is where I reside?

  • 2-3yrs for something costing 2-3K would be reasonable.

    As a general rule, if there's a problem. Deal with it ASAP.

    Have you even contacted scorptec to see what they say about it?

    • Yes I have. MY original RMA was cancelled and then I requested a second one and promised this would go through. However they reneged on their promise.

          fair trading can only ask the supplier to address the customer's concern. they can't force the supplier to accept a warranty claim outside of the warranty period.

  • Wouldn't say 2-3 years, that's the length of a mobile phone warranty ($600+ phone), not a $39 power bank…

    Personally I wouldn't expect longer that 1 year warranty. Why not just get a $18 xiaomi power bank and be done with it? Seems like a lot of work to pursue solution for $18.

    • How much capacity and where can you buy the Xiaomi power bank? I prefer plastic to metal covering as it doesn't scratch my screen. The capacity of the Romoss is 10,000mAH.

    Hi Scorptec Employees,

    I have posted it on Scorptec Facebook Wall; Ozbargain; and a complaint to Victorian Consumer Affairs. Depending on response and time I will also post to Product Review.com.au; Google Local Places; ACCC and Queensland Fair Trading. If necessary I will also go to mediation and then the small claims tribunal.

    Whilst the amount is small it's the principle of the matter.

    And received the following in reply:

    Hi Darryn,

    After consideration, kindly rebook the powerbank in for warranty. You will still need to send it in before the replacement can be arranged.

    Take photos of the unit and send it to us before shipping it back. The unit will be inspected when we receive it. Include the receipt of postage in the shipment. If there are isn’t any signs of physical damage, we will send you the replacement unit and reimburse the freight for sending the unit in. If there are signs of physical damage, we will still send you the replacement but freight will not be covered.

    I agreed to those terms and will keep ozbargain updated to the status of this warranty claim.

    I hope this will be a mutually beneficial outcome.

    Also does anyone know about packing lithium batteries for postage back? What is the conversion of 10,000mAH at 3.7V to Watt-Hours? How many cells does the Romoss have?

    I'll ask Scorptec that as well.

      Should have formatted that letter when my $1400 fridge and 50” tv packed it in recently.
