Can a Car Get Booked More than Once on The Same Spot on The Same Day?

The other day, I was parking at an 1 hour pay and display street parking spot.
When buying the ticket from meter, noticed an Audi Q7 in front had a parking fine on the wiper.
Half an hour later, I came back to my car, a parking ranger was printing another parking fine to the Q7.
Made it a Quinella on the wiper.

Just curious if it is possible -
that a car can be booked more than once on the same spot on the same day for the same offence,

Edit: add poll, to study the general thought.

    On the hour,every hour.

      then15 minutes parking = jackpot?

      • Yup, I've seen it before. 10 minute loading zone (non-commercial vehicles). Merc had 10+ tickets.

  • +1

    the answer is, it depends

usually, one ticket per day is enforceable - regardless of type of restrictions applicable to the parking area

the parking nazi can issue as many as he likes, but whether they can be enforced is (IMO) more important

    • You call an employee doing his job a nazi, yet you say nothing to the person breaking the law. I do not understand.
That employee is making parking more accessible for other deserving shoppers, helping the local shops and other business to stay afloat to maybe one day help you! It is simply the rules, why blame the messenger?

If you truly knew what a 'nazi' was, and or what they did during the WW11 era, you would hang your head in shame. Are you going to call the Police a 'nazi' the next time they arrests a rapist in your home?

Don't feel bad, just please learn to express your feelings in a more correct and justifiable manner next time.

it was a throw away line

i am from german jewish stock, so i have a fairly good idea about who they were !

it was more about their mentality of follow orders blindly

police are decent people who exercise discretion every day, parking inspectors don't know the meaning of the word

        • So am I, but I still never say these words, in jest or otherwise.

My mother was tortured by the Nazis as she was in the resistance, so ….., but I still do not call a Council employee anything as such. Somethings are just not jokes.

          @doctordv8:

like i said, it was a throw away line about their mentality, it was not a joke

          jokes are funny

      • Thought the nazis were in WWII, not WW11. Was that in 3045, Futurama anyone?

  • I recall this issue was challenged in Melbourne Magistrates Court some years ago against Melbourne City Council and council lost as driver could only be fined once. It may have be appealed and decision reversed

OP are you assuming that the first fine was for the same day? Sometimes people put old fines on their cars in the hope of tricking parking inspectors into thinking a fine has already been issued and not issue another one. Without having had a look at the fine, it would be hard to determine what the fine was for and when it was issued.

The parking inspector on the other hand, could have just been starting their rounds thinking I have just come across the said Q7 and not issued a fine earlier for it, therefore, issuing their infringement notice…

    • This. A previous mate who turned out to normally tell me things that were complete and utter Bullshit said he once tried this and it worked.

Still the point is the driver probably tried this and the inspector saw it and issued a new fine.

      • maybe true. also often sees ranger check the previous fines on wipers. more in CBD.

A few years ago i got fined twice. I got one on the windscreen, then about a few days later i got another fine in the mail for the same offence but the time difference was a few minutes later.

I ended up calling sdro and they cancelled one.

    • +9

this happened to me, and they both got cancelled, as they invalidate each other according to the gccc

have Not been convinced at the moment, so did a bit more research on mr.google - typing "car fine parking twice" .
found two relevant old threads here in 2007 and here in 2004.

after reading, still could not to certain.

In one comment by eddy, "The general feeling is that once you have a ticket, then you might as well leave the car there for the day. That's what i always thought!,"

  • Park once, pay multiple fines all day. says
    "The review found:
DESPITE a Government commitment in 1999 to change the law, it still prevents multiple fines being issued for the same offence on the same day" in 2003

It definitely can park once and get seperate book on seperate days. example

    • Article number 2 I understand, it's on two separate days.

The first article though, sounds like a city council attempt to grab more money. If it was in a dangerous area like the article said, they normally fine once and tow your car the 2nd time around.

  • For those who select "yes", is it possible to suggest a reference.

I think it is possible to be issued a parking infringement but if it was actually taken to court it would be considered the exact same offense "staying in parking spot for time longer than permitted" (or whatever it's called), as the offenses themselves are not worded in a way that puts a timeframe on it to be considered separate offenses.

Sounds like to me the parking officer is being a real prick and betting that the owner of an R8 would rather pay two then to fight it in court. If he's wrong, they still at least one fine upheld so the council can't really lose. I wish there could be something done about abusing the system like that but I'm no lawyer

  • Not on the same day. The car must have been there for longer.

  • I remember reading a document from RTA ages ago saying a more than one fine could be issued on the same day for the same offence. I think the targets for this rule are speeders and drink drivers. Using it for parking offences is just revenue raising

Probably the document is now obsolete but the equivalent document would be the one that guides you how to dispute a fine

    Edit
    See page 7 http://www.sdro.nsw.gov.au/lib/docs/misc/br_001.pdf

  • Keen to test? Some rangers are desperate to get quotas for their bosses. Try leave your car there a day you probably get 23 tickets.

  • ticket can be issued again, if the time period of the limitation has surpassed since last ticket

12:03 car parks, and gets ticket in 2hr spot
    14:04 inspector issues ticket
    16:05 inspector issues ticket
16:09 driver returns to vehicle and swears alot.

  • in melbourne car parks cannot enforce parking fines.
councils etc can but private car parks cannot.
there are sources online for this information but its also been on the news too.

as i said Melbourne, Victoria AFAIK

    • so they should not. read this re private car park fines/payment notice.

    • +1

But they can ask (and presumably pay) council to patrol and enforce the parking. A lot of shopping centres have signed up for this so that cars can be fined for overstaying.

  • Yep, as said above if it relates to a time infringement then yes. If is for failing to buy a parking ticket or parked in say a taxi spot then it's only once per day.

    • do you mean this for reason of review.
"I received duplicate penalty notices for the same
offence and the zone or time limit had not recommenced or changed.
Note: This does not mean that a vehicle detected for repeat offences cannot be given penalty notices for each separate offence committed."

      • Yes, it is my understanding something about "having enough time to correct behaviour". IANAL

  • I recently had a 2nd fine for stopping in no-stopping zone repealed as it was a 'continuous offence'.

I was fined twice when I accidentally parked in a no-stopping zone (thought it was my usual parking spot, stupid me didn't realise it was the one behind and thus in the no-stopping zone)

I could stomach a $248 fine but not a $496 fine, thank goodness the 2nd one was waived when I appealed.

    • twice-how much time apart - same day?

      • same day, 11am and 2pm. The 2pm fine was waived.

I'm really sore about that fine considering I spend a lot of time ozbargaining to save $1 and $2 here and there. No more bargains for me for a while due to my silly mistake :(

      • Basically I think the answer to the initial question is "it depends"…. eg. what was the offence, what was the time limit, how far over the time limit was the car, etc… I feel I got lucky in being able to have the fine waived as I know that they do say "This does not mean that a vehicle detected for repeat offences cannot be given penalty notices for each separate offence committed." I was so worried I would get fined twice because of that line.

  • Perhaps you could ask the local Authority in question. Or, read a few..many many pages of Law Text governing the question, or try it out in court after getting a few same spot same day fines.

    For your poll…..
I would rather follow the time limits in the first instance and be a better example to my kids and fairer to others.

Then failing my tardiness or disrespect for other people, I could write a letter explaining my views on the times locations, details a minute/an hour over, and hope the fine was cancelled or even reduced.

If that fails, I man up and accept it.
I stuffed up, not anyone else, and I shall be responsible, but I shall NOT (as we see and hear in the news) abuse a Council employee for doing his job, or be childish with name calling or other such derogatory cussing.

Now here is an Ozbargain idea……. follow the times on parking signs, and save possibly heaps of $$ in fines/towing etc.
