P Plate Red Passengers (Victoria)

Am I allowed to have a brother and friend in the car when I'm a P plater ? Both under 21 in Vic

    NSW law "Peer passenger condition: If you’re under 25 and hold a P1 licence, you must not drive a vehicle with more than one passenger (other than the driver) who is under 21, between 11pm and 5am"

  • Just realised your profile says NSW so, after 11pm and before 5am, you can only have one of them. Unless you're 25 or over, in which case, you can have as many as your car can handle.

    one peer passenger is anyone aged from 16-21 (inclusive)

    exclusions: family members (immediate, not sure about cousins), driving in the course of employment (with referral letter from within your company), and i'm sure there are others.

      brothers and sisters are excluded but cousins are counted as a passenger.

    "Must not carry more than one peer passenger aged 16 to less than 22 years of age.
    This restriction will not apply in the following circumstances:

    a member of the police force and is driving a motor vehicle in the course of duty, or

    a driver who is driving an emergency vehicle in the course of employment or duties or in accordance with terms of a contract or any engagement, or

    whose driver licence is subject to a condition that prevents carriage of more than one other person, or

    when an experienced driver is sitting beside the driver, or

    who is driving a motor vehicle while under the instruction of a driving coach who is present in the vehicle, or

    when VicRoads has granted an exemption from this restriction"

      Except in the first 6 months of having your provisional licence where you can't drive between 12am and 5am (with some exemptions).

      • That's why I only said we have no passenger restrictions.

          Excellent point sir (or maddam). Though it is kinda worse than having passenger restrictions.

          That is true but I think most other states have both. Those six months fly by and as you mentioned there are exemptions for people traveling to work etc

          not both AFAIK, just the passenger restrictions only occur in that time period.
