Sold Fake Nutribullet

Hi all,

Need some advice. I purchased a Nutribullet in September 2014 from ebay. The advertisement advised that it was a genuine article and it came with a 1 year warranty.

In February this year, the device failed. I have to date performed the following:

1) contacted the seller through ebay to get a refund based on the fact that the device is a fake (compared to a friends original) and it has stopped working. No response

2) Contacted ebay saying they couldnt help. All they could do was give me the seller name and mobile number. Got through to him once but since then he has never answered my calls or text messages.

3) Contacted paypal to lodge a dispute saying i was sold a fake item. They said I was not protected as it was some time since I had purchased the item and they couldnt help.

4) contacted the credit card company. they would arrange a charge back as the timeframe for that has passed

5) contacted VCAT to see if i could take the seller to VCAT to get my money back ($180 or so). For this to occur, I need to find an address. Is there any way to do this with only a telephone number, State and Name. Nothing comes up in the white pages.

Would love to hear from others as to what i can do. I understand its a small amount but its the principle.

    Ebay = Scammers that know how to play the game more than you.
    People get rich from ebay loop holes every day and ebay helps them, not you the seller.

          Most people seem to argue that eBay favours buyers, but you seem to be claiming the opposite. Why do you think that?

    What if you google the number? Or Facebook stalk them?

    • I know his name and telephone number (provided by ebay). I believe I have found his place of employment where I might be able to send the VCAT application as well. I will enquire with VCAT if that will suffice.

    Moral of the story, don't buy dodgy things from eBay.

    • It was advertised as genuine and came with a 12 month warranty. Basically the seller did not advertise his goods accurately.

    • no the seller was ozbargainmarket. he is no longer a registered seller from what i can tell. Might have been suspended after i reported it.

  • you can get his account suspended. I was sold counterfeit goods some years ago and EBay suspended his account. Other option is buy another one from the seller even under a different name, send back the old one within the Ebay protection period and get your refund. At least then you have a fake on that works, as it seems you,d be happy with a repair which they wouldn't do.

  • Update:

    The guy got back to me after I called his place of employment asking to speak to him. Supposedly he did not know they were fakes until Customs destroyed $12,000 worth of his subsequent order. He advised that he was broke and unable to pay up…..or replace the unit…..

      • No solution as yet. I said I could not accept $50 and require a refund. He has not replied as yet.
