Dodgy eBay Sale, ACCC All Stores Involved

Hi

Anyone think we have a case to report to ACCC, about the dodge ebay sale..
or rather the dodgy price increases by stores like Dicksmith

This has happen with all ebay sales this past year..and I am sick of it!!

Every time ebay has a sale, the stores especially Dicksmith jack up to ridiculous prices

Some e.g.
Ps4 + last of Us (remaster) = $999

    This thread covers prior transgressions by DSE in particular, and mentions how DSE got off scott free from NSW Fair Trading. My suggestion would be to report them (again) as eventually repeated complaints might force some sort of action.

    • I think a few complaints won't make much different, but if a large group does it, then we have a case..

      Also that is NSW fair trading, we should report to ACCC, which has a lot more power

      Take photos, screenshots as proof..

      They can't say it was an price error for all of it, and for everyone's complaint..

      Aren't ebay paying the 20% discount to dick smith?

      All they are doing is damaging what little reputation they have left as a seller..

      With these dodgy business tricks…
      No wonder people aren't buying from local stores anymore…

      I can't wait until the day, amazon or some US stores sets up a local store /shipping to Australia..

      Then it's goodbye Dick!

    Just about every retailer in business today screws with their pricing to trap the unwary.
    Ever been grocery shopping?
    It all comes back to the shopper… are they a floater or are they product price savvy?
    Effort = rewards.

    If a business screws with their prices so what.. it you fall for it then it is your problem not theirs.

      It is also very dodgy…

      that know ebay will have a sale 20% off

      then dicksmith jacks up prices by 20% or more…
      and also on their own online store, prices are listed lower than the ebay prices..

      then immediately after the sale, price go back to the regular listed price…

      It's very misleading, dodgy business practice…

        Dodgy… yes, uncommon… no, very common.
        Go for a drive down the street and see if you cant find a business with a big sign saying SALE..
        As I said, it is up to the individual to be savvy, do their homework, know a little about the product they are going to buy.

        Most people will see a sale sign and dive straight in… who's fault is that?

        I agree that dse can be tricky with their pricing but so is every other business.

          Doe not make it right!

          Do you think they should be able to keep doing this every time an eBay sale occurs?
          It is attitude like yours, that allows these dirty tricks to continue..

          If you feel that something is not right, you should report it..

          Dick smith is a large national store

          They should be punished for these scams..

          I think there should be a case for ACCC to look into..

          I think there was a recent decision by ACCC about dodgy discount sales

          If u can find the news link there post it..

          Every business manipulates prices… helloooo!!!
          Retailing a product means… selling an item for the maximum amount people will pay for it. If that means fake sales or any other lure then so be it.
          It is not new… almost every retailer does it so why are you singling out DSE?

          If you own a car and buy fuel… here is one for you… the supermarket 4c off docket scam… don't you realise that you don't get 4c off?? Check their prices against most local petrol sellers and you will see that the grocery servo is usually 1 or 2c dearer than them. I saw one that was 9c more!! So, how much is your 4c discount?

          These things are everywhere… the world is not perfect and never will be.
          It is and always has been up to the purchaser to be product savvy.

  • I think so. See my comments on page 5 here. DSE were selling a TV in this sale at a higher price than was advertised in their catalogue.

    I suggest anyone who are pissed off about this dodgy trick by the Dick..

      all good here. we got the 5 items we wanted from the sale. the price was the same before, during and after the sale.

      • Yeah, almost hate to say it, but same here. Closely monitored the prices of a TV over a month before the sale, no change, got 20% off…

    It is going to be difficult for anyone to do anything.
    A retailer has the right to change their pricing at anytime they like.
    All retailers do it.
    Price something at Myers or DJs then go and look at that same item at a discounting retailer.
    Should we report Myers and DJs to the ACCC because their prices are not the same as everywhere else?

    • well discount retailers and a large brand store are usually not linked in the way the ebay store and chain are linked, the prices are increased during sales to promote the sale while still remaining the same price or similar price. Definitely immoral, illegal? I am not sure I will need someone who is more comfortable with the current laws pertaining to this incident to comment. I remember reading somewhere that doing this is illegal but as I said before will need someone else to comment that has a more thorough knowledge of this specific incident and the pertaining laws.

        The easiest way to solve your predicament is to change your attitude.
        You will never change the world to be perfect.
        Why you choose to pick dse for your vendetta is beyond me when every other retailer does exactly the same thing.

        I mentioned before grocery retailing.. do you do the grocery shopping at home? If so then you will know very well what I am referring to. Their tricks and cons make a joke out of dse little games.

        BTW.. I have managed businesses and also ran my own for many years as well as being a purchasing officer for the majority of my career before that.
        If you want the advice of a commercial law expert then you better go and see one because you wont find one sitting on an internet forum giving out expert advice for free.

        • I was merely stating that I was unsure about the situation whether it is illegal or legal, stating that it is immoral, my post had no reference to DSE directly as I stated discount stores usually have no relation like how big brand stores can have ebay accounts or online stores, as discount stores usually don't have websites. also if you never try to change the world you will never succeed in changing the world, that bit is basic logic, I understand other stores do tactics like this and they are very likely just as immoral and as I said before may or may not be illegal. no need to be an ass, just saying.

    • That's only part of the story. The ACCC takes a dim view of retailers misleading consumers - because they are required to by L-A-W. It's arguable that any merchant or facilitator (Ebay) could be found to be contravening the Act in the case of Buy It Now goods. Cases where the "normal" ebay price has been raised prior to a 20% off sale could easily be construed as a classic bait and switch - if the ACCC would get off its @rse and investigate.

      Graeme Samuel has been quoted as stating that consumers deserve truth in advertising and "the ACCC will continue to tackle retailers that persist in using misleading or false representations in advertising". Seems he's as guilty at raising false expectations as some of those he chases - even with the ACCC's limited resources.

    in one of my comments you'll see the link to the ACCC examples and i agree that the promotion is misleading, but technically the retailers ARE selling it at whatever price they list them for… so maybe in this case ebay may doing the misleading?
