It's very unlikely you would get into trouble, but it's good to do the right thing. Merchants pay a higher subscription price for the privilege of publishing notes.
Halliday/Wine Companion is a bit of an "exploited brand" these days, but with various bonus and discounted membership deals a subscription is a cheap investment for those interested in wine.
