Garage Parking

I live in block of 10 units and I have been allocated a garage. Outside the main building, there is big parking area dedicated for resident parking and it is generally full.

Between the main entrance door to units and my garage there are two more garages and then there is one more garage after mine.

The residents of garages who are after and before my garage dont use their garages however there is one old lady who parks her car in the very first garage next to entrance.

I usually park car in front of my garage and there is plenty of space for old lady to take in/out her car from garage. The other two residents have no problem with my car however this lady has contacted Strata who has sent me notice saying it is illegal for me to park in front of my own garage. I have been parking there for last 2.5 years and there was never an issue and this old lady is also living there for the same period of time.

What is Strata right to say so when there is no sign to prohibit car parking in front of garage and I am not blocking garage of anyone?

    My guess is that there is a rule in the strata agreement that prohibits parking in front of a garage, or at least that restricts parking to certain areas.

    You don't say whether you're an owner or a tenant - if you're a tenant, then there's probably not much you can do. If you're an owner, and you want to remove or amend the rule, do whatever it is that the strata agreement says you have to do. You probably have to get the agreement of a majority or some percentage of the owners and then call a meeting to vote on a change to the strata agreement.

  • Just out of curiosity… what can Strata do if you continue to pack in front of your garage?

    • The strata agreement will no doubt define what the body corporate can do, possibly all the way up to having the power to make you sell up and leave.

  • Front of garage is common property unless otherwise stated. Sorry you lose.

    You may say it doesn't cause any hindrance. Potentially it does and it has taken 2 years for this little old biddie to take the courage to stand up to you.

  • As above re strata laws, but double check your own bylaws. You may have exemptions.

  • A few years back i was about to purchase a Villa,
    there was only two in the complex- one long drive with the one i was interested in at the rear.
    I wanted to park my trailer beside my villa(not on the driveway) so my Solicitor said i would need legal agreement to do so. Never got an agreement from the other owner so didn't go ahead with purchase (and got my deposit back too)
