Kogan sues wholesaler and wins injuction over the unlimited plan fiasco, Customers now safe

A new twist in the story. Read Part I for a bit of insight. Kogan didn't take this sitting down and when asked for a response last month they blamed their wholesaler, ISPOne. We've all heard that before (ahem ..Telstra Wholesale) but they actually took them to court. Fairly drastic and commendable response but surely doing this puts their wholesaling agreement at risk. I wonder if we'll see Kogan Mobile eventually switch to Optus as a wholesaler.

  • The Australian briefly reports that it was ispONE that:

disconnected hundreds of the retailer’s mobile customers and “flagged” thousands more as ineligible to renew their service.

Although I'm finding it hard to believe that Kogan is at no fault whatsoever.

  • Here's some updates from ITNews

Telstra reseller ispONE has agreed to stop suspending Kogan Mobile users from its network without Kogan's approval, unless in accordance with the service suspension policy.

So maybe Kogan Mobile is safe to use now? Also here's what ispONE said, according to the article:

Counsel representing ispONE sought to have a reference to Telstra included in today’s undertaking, arguing it was Telstra, not ispONE, that ultimately carried out the suspension of users from its network.

    Yup. "Someone else's fault".

    • unless in accordance with the service suspension policy.

Pretty big get out of gaol free.
