    Dealboard was entered into External Administration. Their offices were locked, and the founder, Samuel Gulbahce, is under investigation by A.S.I.C., the A.C.C.C. and the Office of Fair Trading.

    He's no stranger to the OFT. He is listed as the youngest person ever to be banned by the O.F.T. from a previous venture he flopped; and he's also been on Today Tonight under a segment called "Sam the Scam." He was declared bankrupt previously, and has another failed business RSG Ventures Pty Ltd that was also wound up by its creditors.

      I am with you on this venture. This guy needs to go down. How the hell can ASIC and ACCC let this gut get away with it and if he has already be banned by the OFT why was he able to start a business. ACCC and ASIC make it hard for legitimate companies to do business so how can they let some upstart do what he has done after already being on the radar?

      • Depending on time frames, he cant start a new company as a director but what a lot of these guys do is grab some random person to be the director of the company while they run the show and the the director just signs stuff for a fee. I used to work in Insolvency, the law makes it very easy for these guys to keep operating. ASIC is also only interested in the big guys so if this guy was ripping off a couple mums and dads, nothing will come of it, especially if all the money is gone and unlikely to be recovered.

  • i purchased the Madrid from them back in November and it hasn't been delivered. anyone have any idea about how I can go about getting some money back? PayPal won't help as it's past 45 days since I bought it. I have sent an email to the ACCC tonight, but will have to wait and see from them.

    • I too purchased an outdoor setting (700 odd dollars) in November (more than 45 days ago). Have raised a dispute with Paypal and mentioned that delivery was supposed to be between 4 and 12 weeks - hence I did not think anything of not receiving the item…..let's see what they come back with…..pity that this info about Sam the scam was not uncovered before - it would have been good to advise a Current Affair or Today Tonight so people were forewarned…

        It was, but you had to be quick to see it before it was removed.

        It was on Facebook several times, on Whirlpool, and even here.

    • I did the same, bought the bed back to Sep, contacted Dealboard when 12 weeks passed, they claim it's a logistics problem, letting me wait till end Jan. Lodge a complaint to fair trading. Unfortunately, I pay it by paypal bank transfer, so got less option for getting the money back.

      Any one got idea about the refund? Or let me know what I could do now?

  • Is anyone aware of who the Administrators are? Out of pocket $639 for a SUP board. My biggest online purchase ever, mmmm… I already attempted to lodge a dispute with Paypal a month ago but they said this type of item was not eligible for a resolution case. I wonder what it, because I tried once before as well! Strangely it was only last night that I sent a query to Dealboard as I was at 11.5 weeks of the suggested 6-12 week delivery date. I should have learned, the only other item I bought from them took 4 months!

      • And make sure you really pressure them and say that you were scammed, make sure they know that this guy is being investigated and stuff. The bank will probably say (as soon as paypal is mentioned) "do it through paypal, sorry". So try to avoid mentioning paypal.

        The next step would be ACCC or something.

    • Try with your bank but at this stage the administrator has seized control of the bank accounts and any money that leaves the company's account now, the administrator can claim back from the bank so I doubt you can successfully get your money back that way

      The next step is to contact the administrator and ask to be added to the creditor list and ask for a proof of debt form.

      In my experience (working 6 years in Insolvency) there will be a long winded liquidation period at the end of which you will receive this information (numbers are an example);

      Realised Company Assets - $50,000
      Administrators / Liquidators Fees - $50,000
      Money left over for Creditors - $0

      Sorry to be pessimistic but liquidators are rich for a reason, they adjust their fee to ensure it matches the realised assets. We call the job a cash cow at this stage, everyone charges it (even people not working on it) and once the money is gone, we start charging the next cash cow.

      If the job gets enough media attention, they may leave some money for creditors, usually 15-20 cents in the $

    i just got off the phone to the bank
    they asked me to drop in any info asap , that being said it could take up to 45 days and even then I might not get any money back. Cross fingers and hope I do. Also put through disputes on pay pall. I'm annoyed to hear this bloke has done this before and my heart breaks to think of everyone else who's been ripped off!
    any advice for anyone who's been through something like this and got their money back? Or is it just something i have to chalk up to experience

          most banks will look at the info confirm that it is correct and just take the money back from paypal.

  • I previously placed an order with Dealboard for a Bladeless Fan. After chasing up on several occasions it arrived well past it's delivery expiry date, and was 2nds quality merchandise, scratched badly in several places. They finally replaced it, which was acceptable. Given that the company finally honoured the order, I ordered in November the Egg-Shaped Pet Bed for Dogs and Cats @ $99.00. There was up to 12 weeks delivery - so now I find they have Administrators………..I have lodged a dispute with Paypal, on line and followed up with a phone call. Paypal advised they are receiving a heavy call load regarding Dealboard. I have also contacted my bank to lodge a dispute, however this may incur a fee of $10.50. More money down the drain, if I don't recoup.

    I just don't understand how these criminals keep dusting themselves off, start up new ventures and continue to defraud the public - it's not the first time. Another company that I have dealt with is Why Pay Full Price. I have purchased previously and not had a problem, but more recently I purchased a Bio-Ethanol Heater, which was not delivered and finally they were unable to supply as advertised. I did receive a refund, however there was a lot of emails before this happened. I am now very wary of them.

    I wish paypal did not default to bank acounts or take the money out of your balance unless that was your specific choice.

    I've printed out the info last night from deelboard.com.au, alot of info regarding old Scammy Sam's address and Paul Florat(director) as well. Probably why it's disappeared all of a sudden. Good Job to whoever set up the site, we need to do something about the SOB.

    Basically it said Lodge a complaint with the Office of Fair Trading and Lodge a complaint with the A.C.C.C.

    I've already lodged a complaint with Consumer Affairs Victoria b4 Xmas about not getting a refund for a faulty tablet - should have known it was too good to be true when I saw the price - $179.00 back in Dec 2011! Old saying "This to shall pass, but b4 it does I want a chance to kick the SOB up the ass.

    I ordered a bed from Dealboard in July 2012 - after many conversations with them i was promised delivery this week. I took my existing bed to the tip yesterday to make room for my new one …then got the e-mail from the administrators last night. Now I literally have no bed to sleep in and am unlikely to see my $1300 again.

    I am so angry that people like this are able to operate a business. The ironic thing is that Sam the Scam is probably sleeping comfortably right now. SCUM!!!!

  • Just a point of clarity for Dealboard/Deelboard/OST's comment. You make it seem that OzBargain, Whirlpool etc are removing your posts etc. The issue is you have created 3 separate accounts (as of this comment NONE have been banned) and are posting the same comments over and over. I count the same comment here 4 times! Only 1 account is permitted per person here (and Whirlpool) so please pick 1 account and use it.

    There is also an issue with posting libelous statements about individuals in Internet forums. Stating facts and opinions about Dealboard are fine but once you delve into a person's life, you put at risk the websites that you post on. See Zgeek or Google/Yahoo's recent issues.

    While not going to much into the issue, for transparency sake, I think it would be worth telling everyone what your relationship is with the company/Sam.

    Hopefully, these legal proceedings are against the person(s) who are 'really' behind (the defacto owners of) DealBoard - and not against whoever is/was posting the info. on deelboard.com.au

  • Don't know about anyone else but I have just rang my bank - Westpac and because Dealboard is in external administation I would be just put on a list of customers affected by Moore stephnes - administrators handling this. I can't go to paypal as I'm over the time limit. The only way to stop Samuel doing this is to put pressure on the Office of Fair Trading & the MP's to put legisation in place and get a criminal conviction on these guys!

      Yes, it had some good and useful advice, as well as some very interesting information about those allegedly 'behind' DealBoard and about their past activities.

      Interestingly http://www.dealboard.net.au still exists as a web site. Perhaps for use in a 'Phoenix' operation in the future? Also, I saw that a certain 'brother' has registered at least 22 new domain names between mid December 2012 and early January 2013.

      There is still gulbahce.info with some rather bland, but completely factual and legal (no chance of defamation/libel), information from publicly available government sites about two Sydney based brothers.

  • I made an order on the 19 November 2012 and received nothing also. The email from the administrators arrived on the 15 January 2013, but the hideous pigs from Dealboard were still sending emails offering goods to purchase. I received the last one on 13 January 2013. That is two days before the administrator. There's a stench of criminal behavior about this.

  • Keep hammering Paypal, I have done it 4 times already and finally got the same response some of you have had about reopening the case after 180 days if there are enough complaints. The morning after I got the Administration appointed notice, I called Paypal. I was told then by an officer that they held sufficient funds in the Paypal account of Dealboard to refund the affected buyers. They have locked that account and were working on a system to release it (this may also involve permission from the Administrators). He also told me that as Administrators had been appointed it changed everything regardless of the timeframe. I then emailed for confirmation of that conversation but unfortunately have since been met with the response I lodged my dispute outside 45 days…even though I pointed out they suggest delivery of 42-84 days making lodging a dispute fruitless by 45 days. Unfortunately, I selected "pay after delivery" but then used my savings account because my credit card was nearing its limit that month…(d'oh and I pay it in full every month, so no claim back there!) I also intend to lodge a complaint with the Finance Ombudsman. I am not going to sit idle by and not do everything I can to re-coup $639! Oh and as I expected Deelboard to be shut down, I copy and pasted the info that was posted at that time into Word..at least I was diligent there! :-)

        Ordered SUP Board in October 2012 - $639. Despite non-delivery of my item they still advertised the sale of the SUP Board twice since. I did lodge a dispute with Paypal but sadly out of the 45 days. I used Paypal's option "Pay after Delivery" and believed I still had 45 days from the time they withdrew my money. I lodged my Complaint on 22.12.12.

        I have explained to Paypal that lodging a dispute by 45 days would have proved fruitless as the expected delivery was 42-84 days. After contacting Paypal on 4 occasions, they now advise they may extend the dispute date…so ..Please please tell as many people as you can…contact Paypal. If enough people report the same business, Paypal will extend the claim period from 45 days to 180 days…

I wanted to make comment as someone else suggested that PayPal should be implicated. I already had that thought and made a complaint to the Financial Ombudsman about PayPal last night. How were Dealboard and its Directors allowed to open an account with their background I wonder? I know the business I work for have had to produce a number of documents and proof of ID etc.

  • Perhaps another way of getting the word out about contacting PayPal even after the 45 day dispute period, could be letters to the editor or community notice board of our free local newspapers.

      It really should be Moore Stephens Accountants that do something about this.

      They should be 'on to' Productreview.com.au - and they should be advising all customers of Dealboard to contact PayPal.

      They are meant to be acting in the best interests of Dealboard Pty Ltd and its creditors - not in their own best interests (ie. getting the PayPal funds back in order to extract their own fees before distributing the balance).

      I find it suspicious and concerning that they are ignoring our calls and emails. I had to call them again, and finally got to speak with someone from their 'Dealboard Team'. He really was not interested and said that it was up to ProductReview to 'vet' who can remove comments from their site - he just does not 'get it' (that it may be Sam who is interfering in the business that they are administrating).

  • I lodged another Review last night, different account. I got an email saying it was approved and saw it online. Now I see this REVIEW has actually been removed as well.

    IT READ AS FOLLOWS:
    They take your money and do not deliver. Rogues and cheaters. We can do something. Contact PayPal urgently even if you are outside the 45 day dispute period. If enough people report the same business PayPal will extend the claim period from 45 days to 180 days BUT we need your help! All comments of this nature have mysteriously been removed and the writer blocked out of Product Review. You must write a REVIEW as this can not be removed by anyone other than Product Review. Do not just add a COMMENT as this mysteriously disappears. In your REVIEW urge everyone to contact PayPal so that the claim period can be extended from 45 to 180 days and we have a hope of getting our money back.

    Also consider lodging a complaint with the Financial Ombudsman implicating PayPal for allowing DealBoard to facilitate the scam by setting an extended delivery date thus making it futile to lodge a dispute with PayPal within 45 days.

    "PayPal have 'frozen' the Dealboard account. There is enough money held there to refund everyone who paid in the past six months. The Administrators would be trying to get PayPal to release the money to them - so they can extract their fees first and then add the remainder to the assets of Dealboard to be divided among all secured creditors (banks, tax department etc.). Anything left would be divided between unsecured creditors (such as customers). If PayPal receive a lot of complaints they will extend the claim period to six months and refund all customers who make a claim for 'goods not received'."

    I wonder how long it will last before being removed?

    • Tax department isn't a secured creditor. Bank is if they have a charge over the company assets which they probably do. If there is a secured creditor and they get worried about the situation, they may appoint a receiver which many do. At that point you need money to pay administrator, receiver, secured creditor, liquidator. I dont like the outcome for unsecured creditors in this one.

  • My review that was there and then was removed took 7 hours for it to get approved. I also attempted to add a Review that appealed to Product Review to assist us in stopping the comments being removed. I didn't seem to copy that one darn it. Not surprisingly I have heard nothing about approval on that Review and my account has been blocked (again). We can only hope they are staying there long enough for a victim to see them. I also snuck a comment on Deals Direct thread last night. Someone mistook them for Dealboard and I set them straight and what action to take, I see it is removed now as I expected. But they haven't noticed another one yet that was a bit more subtle. You never know word may get around.

  • The administrators are trying to be the good guys by directing customers to PayPal yet really not assisting in allowing that to actually happen.

      This is very, very, strange.

      I know that profanity, foul language, and people's names etc. are removed from reviews (with a note remaining that they were removed) - but removing whole paragraphs from reviews (without any notation given/left) just because they give advice in how to get a refund?????

  • Yes because my comment that still exists no longer makes sense as the paragraph to which I was replying is deleted!!

    • This has actually happened twice. My comment remains that I have also lodged my complaint about PayPal Ombudsman but the paragraphs in both Reviews where the other customers suggest it are now missing

  • However I have been able to encourage a few people on Facebook who believe they are commenting on Dealboard's official site to lodge their PayPay complaint regardless of the timeframe. This is getting exhausting but worth the fight

  • Got told by CBA and PayPal that they won't help me out. The bank says that because the money was a direct debit from PayPal, I need to speak to them about it (the Mastercard so-called "protection" does not help). PayPal say that the dispute is closed because it is passed the 45 day transaction period and refuse to acknowledge that the buyer should have more protection if the seller says it'll take more than 45 days for delivery! Not too sure what we can do next unfortunately.

  • I rang PayPal last night and when I mentioned Dealboard I got put through to someone else and was told they'd received thousands of complaints about them. It seemed like they had someone dedicated to taking our calls.

    Although I opened a dispute, because it's outside the 45 days I'm sure it will be declined. I asked about the 180 day thing and they said that they had the right to keep something open or not for 180 days. It sounded like they would go with the NOT though.

    I then rang my bank and opened a dispute with them. They're sending me some forms to complete and then they'll investigate. No idea if that will result in anything.

    I read someone somewhere suggesting contacting the Ombudsman about PayPal not allowing an extension of the 45 days, that's something that may be worth exploring.

    I also lodged a comment along the lines of the Review they refused to publish:

    Product Review…I can assure you that Reviews are being edited. I have commented twice on paragraphs that were in Reviews previously and now the paragraph suggesting making a complaint to the Finance Ombudsman about Paypal have now been removed in those Reviews! If you are the only people with the power to edit Reviews, why is this happening?!? Why protect DealBoard and Paypal? As you are no doubt aware, all comments about lodging a dispute with Paypal (even if outside the 45 day claim period) are being removed by Dealboard's Representative and the writer blocked out of ProductReview. If enough negative feedback is received about one seller, then Paypal will extend the claim period to 180 days. We require you to take immediate action to stop allowing Dealboard's Representative to interfere with the thread. They lost that power when they went into administration on the 14th January. I would appreciate your response to that here (seeing as you did not publish my Review in that regard!), I fully expect that you will not further thwart the efforts of the victims of Dealboard to recover our funds by removing this comment from this page.

    1) All the comments left in all the reviews, that mentioned PayPal, have been removed!

    2) ProductReview have not replied to messages sent via their contact form and via direct email.

    3) The administrators of Dealboard Pty. Ltd. are just not interested in taking over the administration of the Dealboard account at ProductReview.

    Other than contacting ASIC to complain about Moore Stephens Sydney Pty Ltd I don't know what can be done.

    I find it totally unacceptable that Paypal spends so much time promoting their "safe way to shop" yet have stupid conditions such as the 45 day rule which make it almost impossible to use their protection.
    Surely it should be xx days from promised delivery date (or something!
    Similar the time limit & exclusion of Paypal on credit card charge backs is equaly useless.
    Certainly about time ACCC, etc do something about this.

  • i complained about the same thing to PayPal. My argument was that if a seller tells me that the product can take up three months to be delivered, their so called "buyer protection" is irrelevant. As per usual though, they apologised but wouldn't budge on the 45 days.

I just think that the advice one gets depends upon who one talks to at PayPal"…not to mention the advice I got the morning after on the 15th that the fact they went into administration changed everything despite when I lodged my claim, that they held sufficient funds in the locked account of Dealboard to repay everyone and were working on a system to do that…which is why we need to lodge the complaint against Paypal with the Finance Ombudsman.

  • I will try not to get long winded and confuse things but explain what the basis of my claim with the Ombudsman against PayPal is given they try to tell me I am out of the 45 period. Given the extended delivery date, I chose the Pay after Delivery option.

    Date of my purchase order: 27.10.12
    Date of funds taken out of my account: 17.11.12
    Date of my Dispute 22.12.12

    I have found 3 references in their email saying they are deducting my funds and even on the resolution page where they define the PAYMENT out of my account as the TRANSACTION DATE i.e. I had 45 days from the TRANSACTION to lodge the dispute. Well they already defined the PAYMENT as the TRANSACTION DATE, not the PURCHASE ORDER DATE as the TRANSACTION DATE. Therefore in my view I lodged my claim within the 45 days i.e. the payment/transaction date. It is a stretch but as there is contradiction in their emails and terms and conditions etc., I am claiming it is void for uncertainty and/or open for interpretation and therefore I lodged within the 45 days.

    They have also tried to tell me that the Buyer Protection only relations to Pay Now Options. However, in the link in their email which takes you to terms and conditions, it says the Protection relates to ALL PAYMENT types.

    Okay hope that makes sense…a stretch but I think there is something to argue there. Oh and I have taken screen dumps of the web page of those references in case PayPal think they will get smart and go in and EDIT stuff!!!

  • Hi A3. PayPal have received countless complaints about Dealboard according to any staff member you speak to on the phone. That being the case and if there were sufficient funds to cover us, you'd think we'd be covered. That's not the impression I get though, when I talk to PayPal. I hope I'm wrong, but I'm pretty sure we've lost our dough.

  • The mailing list might be 250,000 in volume, but the active customer base is only about 60,000. The other names never bought.

    The mailing list was 'borrowed' from Harvey Normal World Travel. 90% of all of the names on that list were customers of HWT.

  • I wondered how I got on their list, not through World Travel but perhaps through the Harvey Norman Computer Store?! In any case, I tried twice to try and unsubscribe but it wasn't successful. I find it disgraceful the unhelpful so called Administrators should try to sell the mailing list. I know it is a practice, but seems like encouragement for the scam to start all over again by some other company!

  • UPDATE ON PROGRESS: Date of Order: 26.10.2012 - Date of Payment: 17.11.2012 - Date of Dispute lodged: 22.12.2012
    I lodged a complaint with the Financial Ombudsman against PayPal. PayPal said I lodged my dispute out of the 45 days. However, I paid by "Pay after Delivery" so payment was made 21 days after the order. I found 6 references in PayPal's documents where they state the dispute must be lodged "45 days from the date of PAYMENT". I lodged my dispute 35 days after the PAYMENT. I highlighted these references to the Ombudsman and PayPal. They have made no comment of those discrepancies (it even appears on the resolution page) but I have received an email that although they say again I am out of the 45 day deadline (still trying to save face?!), as a "gesture of good will and courtesy", they will be refunding my full $639. Thank you PayPal for seeing reason in the end although it has taken 3 weeks of my time and energy! Good luck to everyone else…and to the instigators of Dealboard, I pray that the law catches up with you!! @#%#

  • Unbelievable…Product Review have put my Review on to PayPal's page not Dealboard's page about getting my money back after complaining to the Ombudsman. They are also now saying my comments that were posted are now "pending". Still interfering! I have never looked up PayPal's thread and certainly did not post it there!!

  • I was very surprised today to find that PayPal had resolved my claim in MY favour and had agreed to refund my money. I rang my bank to see if they had, and lo and behold they actually had. I have no idea why I was successful given I lodged about 10 1/2 weeks after I purchased the product (well outside their 45 day period), but they did. I can only presume I was amazingly lucky and they considered the delivery timeframe of 2-10 weeks from purchase.

    The salient parts are as follows:

    2.1.4

    We were advised that a company related to the Company by common officers, Lov.com Pty Ltd (‘Lov.com’), had also registered a security interest against the Company. We confirm that searches of the PPSR do not disclose any registered security interests besides that of St George. We are not aware of any other circumstances which would result in the security interest being perfected under the provisions of Section 21 of the Personal Property Securities Act 2009 (‘PPSA’).
    Accordingly, we consider that the security interest is unperfected and that the property, which may have otherwise vested in Lov.com, vests with the Company pursuant to Section 267 of the PPSA.

    2.3.5 Arrangement with Lov.com

    We are advised that the Company invested approximately $400,000 of its cash into Lov.com, being a company largely involved in online retailing of beauty products. We consider that these cash outflows further constrained the cash reserves available to meet the Company’s debts. Further investigation into the arrangement between the Company and Lov.com is disclosed in Section 5.3.2 of this Report.
    Our investigations to date confirm the reasons provided above contributed to the Company’s financial difficulties. Further investigations will be conducted into the failure of the Company should the Company be wound up at the Second Meeting of Creditors

    1. INVESTIGATIONS
      Should creditors resolve that the Company be wound up at the Second Meeting of Creditors, there may be transactions where money, property or other benefits can be recoverable by a Liquidator. We will need to undertake further investigations into the following areas, however, we provide our initial findings into:
       Insolvent trading at Section 5.1 of this Report
       Adequacy of books and records at Section 5.2 of this Report
       Voidable transactions at Section 5.3 of this Report
       Directors’ and officers’ responsibilities at Section 5.4 of this Report, and
       Offences at Section 5.5 of this Report.

    5.3 VOIDABLE TRANSACTIONS
    In the event that the Company is wound up, certain transaction that occurred prior to our appointment where the Company’s property was disposed of or otherwise dealt with may be voidable pursuant to Part 5.7B of the Act. These are known as voidable transactions and may result in a requirement for a third party to return property to the Company and thereby increase the assets available to the Liquidator, if one is appointed.
    We will need to undertake further investigations into the following areas, however, we provide our initial findings into:
     Unfair preference payments at Section 5.3.1 of this Report
     Uncommercial transactions at Section 5.3.2 of this Report
     Unfair loans at Section 5.3.3 of this Report of this Report
     Unreasonable director-related transactions at Section 5.3.4 of this Report, and
     Voidable circulating security interests at Section 5.3.5 of this Report.

    5.3.1 Unfair preference payments
    An unfair preference payment is a transaction, generally occurring in the six (6) months prior to the appointment of the Liquidator (the date of the appointment of the Liquidator is deemed by the Act s the date of the appointment of the Administrator) to which the company and a creditor where parties, that results in the creditor receiving more for its debt that it would if the transaction were set aside and that creditor had to prove for their debt in the winding up of the company like all other creditors.
    It should be noted that a transaction can only be an unfair preference if the company was insolvent at the time the transaction took place or that the company became insolvent as a result of the transaction. It should also be noted that while the relation-back period for recovering unfair preference payments is generally six (6) months, if the transaction is between the company and a related party, then payments can be recovered up to four (4) years before the appointment of the Liquidator.
    If a receipt is proven to be an unfair preference, the creditor must return the benefit they received to the Liquidator and it is then available for the benefit of all creditors.
    We have investigated payments made by the Company in the six (6) months leading up to our appointment. Our initial review of the Company’s records has identified a number of payments remitted to approximately nine (9) creditors which require additional investigation to determine whether they may or may not be unfair preference payments. Additionally, we have identified two (2) payments totalling an amount of $9,800 which we consider likely to be unfair preference payments. Subject to receiving further substantiating evidence, we anticipate issuing a demand against the party to repay that amount should the Company be wound up.
    Creditors should be reminded that the recoverability of these payments is subject to significant further investigations and there is no guarantee that any funds will be recovered by a Liquidator. We note that creditors can seek protection from the provisions of Section 588FA and, further to this, the costs of pursuing voidable transactions can be considerable and may outweigh the benefit to creditors in some circumstances.
    5.3.2 Uncommercial transactions
    A transaction of a company is an uncommercial transaction if, and only if, it may be expected that a reasonable person in the company’s circumstance would not have entered into the transaction having regard to the benefits and detriments to the company of entering into the transaction and the respective benefits to other parties. Further the transaction must have occurred at a time when the company was insolvent, or the company became insolvent as a result of entering into the transaction, and generally within two (2) years of the date of the commencement of the winding up.
    It should also be noted that while the period for recovering uncommercial transactions payments is generally two (2) years, if the transaction is between the company and a related party, then payments can be recovered up to four (4) years before the appointment of the Liquidator.
    Our investigations to date have focussed on the agreement entered into between the Company and Lov.com (‘the Agreement’). We note the principle terms of the Agreement below:

    Commencement: 15 February 2012
    Fee: The Company to remit $1m to Lov.com (of which $400,000 had already been remitted according to the Agreement). Monthly payments were to be remitted for the balance. Services and obligations Lov.com to provide the services of Dedicated Contractors (persons with expertise in providing advice in all aspects of e-commerce and online sales) to the Company to:

     Provide advice in all aspects of e-commerce and online sales.
     Hold relevant qualifications, skills and training.
     Act professionally and courteously with the Company’s stakeholders.
     Comply with relevant policies.

    Security
    As discussed in 2.1.4 of this Report, the Company and Lov.com entered into
    the Agreement and a General Security Deed which could have enable Lov.com to hold a registered security interest in the Company. As previously advised, our investigations have not identified any evidence of the security interest being perfected and accordingly, we consider that the property vests in the Company.


    In essence what it appears the Administrators have discovered is that nearly 1/2million dollars was inappropriately transferred to the company LOV.COM

    if dealboard is wound up, those transactions would be 'reversible' given it is the Administrators opinion that dealboard had been trading insolvent for the past 2 years.

    In otherwords, LOV.COM will have to give back the money it was paid by dealboard.

  • So surprised and happy to have received my payment refunded in full by Paypal - never dreamt I'd see the almost 800 dollars that I had spent - wife is happy too - from having no outdoor setting and lost the money - now we've got the outdoor setting and the money back - good to see Paypal works….(even though I was technically far out of the 45 days since transaction!
    Just to clarify - we got the outdoor setting by walking into a bricks and mortar store - no more ordering online for things like that (esp. with a 4-12 week delivery time!!!)

  • I knew nothing about this until yesterday, my 10 weeks of delivery were up, i'd made two purchases in December, one for $49, the other for $249. Thought it odd that every time I tried to open their page it opened a search engine… then I found this site.

    I contacted Paypal immediately, and am happy to say my $49 has already been refunded (less than 24hrs) and the $249 is pending, my dispute was upgraded to a claim straight away, so I'm confident of getting all my money back.

  • i called PayPal and they immediately agreed to give me my money back too! I just called up and said that I heard from other people that PayPal were refunding money, and they agreed that that was the case. Money is supposed to be returned in a day or so.

    If you're in the same boat as the rest of us, call up and start getting your money back! It's made my day :)
