This email provides a brief update on how we are progressing your claim against Optus.
Court Win
What has been happening?
Our last update to you was in early 2024, after the Federal Court granted us access to a report on the data breach that Optus was trying to shield using legal privilege.
Since that time, we have had a number of milestones that we wanted to update you on.
First, Optus appealed against the Court’s decision mentioned above. We won that appeal and have now received a copy of the report and are using it to strengthen our case against Optus.
Second, we have started to receive documents from Optus as part of the discovery process, which will also be useful in building our case against Optus.
Third, we have prepared an Amended Statement of Claim which sets out in more detail our case against Optus. Please note that the amendments we have made do not affect group member eligibility.
Fourth, we have been developing evidence regarding specific experiences and types of loss which will be used to hold Optus to account.
Fifth, the Court has made orders for mediation between Slater and Gordon and Optus. This mediation will take place in late May 2025 and will provide an opportunity for us to seek to resolve the class action outside of Court, by agreement. If this were to occur, we would send you an email such as this one to advise you. If you do not receive such an email, you should assume that it has not resolved by agreement at the mediation.
