Optus Data Beach Payment Update

Has anyone recieved email update from slate and Gorden, looks like matter has settled and won, wonder how much we folks getting after all the pain and suffering with spam, guessing $1000-3000?

This email provides a brief update on how we are progressing your claim against Optus.

What has been happening?
Our last update to you was in early 2024, after the Federal Court granted us access to a report on the data breach that Optus was trying to shield using legal privilege.

Since that time, we have had a number of milestones that we wanted to update you on.
First, Optus appealed against the Court’s decision mentioned above. We won that appeal and have now received a copy of the report and are using it to strengthen our case against Optus.

Second, we have started to receive documents from Optus as part of the discovery process, which will also be useful in building our case against Optus.

Third, we have prepared an Amended Statement of Claim which sets out in more detail our case against Optus. Please note that the amendments we have made do not affect group member eligibility.

Fourth, we have been developing evidence regarding specific experiences and types of loss which will be used to hold Optus to account.

Fifth, the Court has made orders for mediation between Slater and Gordon and Optus. This mediation will take place in late May 2025 and will provide an opportunity for us to seek to resolve the class action outside of Court, by agreement. If this were to occur, we would send you an email such as this one to advise you. If you do not receive such an email, you should assume that it has not resolved by agreement at the mediation.

    Aren't class action suits usually $10 for you and $9,990 for the 'no win, no fee' lawyers?

    Didn't know this was happening, looks like I missed out anyway.

      $10 for you and $9990 for the lawyers overstates it, but you've got the general idea right.

      In the PFAS class action suit I was part of the settlement was $132.7 million of which the financiers got $50 million (38%), and the lawyers some of the rest but only in the millions. And the 5,000 or so claimants split what was left.

      There was a recent one where it is alleged someone was coaching young criminals to make fraudulent claims that they'd been sexually abused as children in state institutions, like youth jails. The example that got in the headlines was a payout to one claimant of $660,000 of which Slater and Gordon got $415,000 (63%) and the claimant got the remaining $245,000 (37%). If the courts decide it was fraud the lawyers won't have to pay back what they got. The police estimated there's been $1.3 billion in false claims, so we're talking about close to a billion that the lawyers have made out of it, and taxpayers won't get back.

      (Of course the other question about that redress scheme was how $1.3 billion in fraudulent claims was paid out. How badly was it run that people could make huge fraudulent claims and they were accepted as the truth and paid.)

    • Wouldn't it be the usual no win no fee split minus their legal costs (which they can pull out of their ass, $1,000 to send an email, etc.).

    • Looked into it and apparently we don't need to do anything or register yet. We can sign up for updates to be notified in future. Sounds like they're trying to win something then start evaluating who is eligible or not.

      Eligible group members do not need to take any steps at this stage to participate in the class action.

    I was an Optus@Home user many years ago, but I left and didn't keep my details up to date. I guess the hackers only have my date of birth.

    End users will get about $0.38 while the lawyers roll around in an Olympic sized indoor pool full of crisp, new $100 bills.

    gov should fine optus hard and australian should band together to change their provider (how hard it is? keep the number, one call to voda tpg telstra done). then, optus may be forced to bankrupcy as they end up with just 1% of the customers (those who are too lazy to to change)
    other companies will see how serious is cost of failing to safe guard our data, instead of taking it lighly because hey look, nothing happen to optus (and medibank and latitude and so on), so why we have to invest more into our cyber security team?

    but hey people just say well its already happen why we need to leave optus…. agree its already happened but we need to give them lesson (because gov incapable or not willing to)

      Ahhhh, yes, that’s just what Australia needs, a telco duopoly made up of a barely bearable network, and a terrible network just so we can teach Optus a lesson.

    From the email you pasted, it looks like S&G won the right to access a report rather than won the class action. Also S&G have started to receive documents under discovery, so it's going to be a long time before any amounts get settled on.

    • That's right. But it would appear having that report is now very good leverage to ensure doesn't become evidence in open court.

      I'm sure it would be highly critical of Optus, and obviously it was done by lawyers to protect it as privileged communication, which has now failed.

    The reason I'm bitter is I had well and truly left Optus 2 years before the data breach. My details including drivers licence was still leaked. Hanging onto ex-customers details that long, and leaving it online is a pathetic failure of privacy and security. In all my years working in IT, the Optus data breach is probably the dumbest breach I've seen. Bring on the class action.

    Probably have to give Slater & Gordon all my personal details in exchange for $10. How ironic.

    • If Slater & Gordan leak our info maybe we'll get another $10 from a Maurice Blackburn class action. Rinse and repeat.

    I just got $39.99 in the ANZ credit card class action which settled for $57.5m. I don't think there is any chance people get $1-3k from this.
