TRS Claim - Invoice Not in My Name

Hi all, quick question but couldn't find an answer online.

I'm traveling next week and want to claim GST on a mobile phone I purchased for under $1,000. However, the invoice total exceeds $1,000 as it includes multiple items, and it's not under my name. Am I still eligible to claim GST?

Thanks in advance!

Needs to be in your name, so no

From experience, they won't accept the invoice if it's not in your name regardless of claim amount.

ABF suggests the matching name is required only for invoices of $1,000 or more. But the ABF officer’s decision is final and you might not get to claim; which is what you're saying has occurred at the TRS facility. So OP has nothing to lose other than the >90 minute queue.

      • The invoice being presented is over $1000, so by that interpretation of what the ABF is suggesting the claim has already failed to meet conditions.

        • Yep, good point, a likely fail

Why should the taxpayer reimburse you if the tax invoice isn’t in your name?

    • Can you ask this of the govt miause of tax money?

Why isn't it in your name?

Also, technically you are not allowed to bring it back into the country unless you pay the GST back.

not if it's under the threshold ($900 per adult returning)

    • Made the purchase before my wife booked a trip overseas….

    Dont do that!

They will staight put a handcuff on the airport and tear your flight ticket on the spot.

    • Lol

  • Have you tried asking them if they can reissue the invoice as two separated ones? Or maybe return the other items to get it under 1K and get a new invoice? Otherwise you're probably out of luck.

Some people are are misinformed, for invoices <$1000, the invoice does not have the be under your name. It says so clearly on the FAQ section of the ABF TRS website. So you can claim TRS on a $900 purchase under anyone's name.

I claimed a $400 iPad for my mum (invoice was under her name), and my sister made a similar sized claim using two invoices in my name with no issues. They didn't even bat an eye.

    • Just went through MEL TRS, and asked the hypothetical; they won't accept an invoice with a name on it that is not the passenger's regardless of total amount on receipt or amount claimed.

      • Odd. We also went through Melbourne TRS with no issues. Did you ask them why their site says it is only required for invoices over $1000?

Edit: Ah I think I know what that means now. So for <$1000 you can show a receipt with no name on it (like the one's you normally get) but for >$1000 it must have your name on it and no one else's. I stand corrected then. So it sounds like if you plan on claiming on behalf, buy in store so you get a receipt with ABN but no name.

Thanks for checking, probably saved me some grief in the future

        • I guess it comes down to the discretion of each individual agent. I've had conflicting determinations at SYD before, the (newish) agent initially said they were going to decline my claim because it was over $1000 and I admitted that I would be bringing the item back in. A second agent saw and corrected that it was fine and it was up to me on re-entry to declare properly. I was leaving the country by myself but re-entering with family and thus could pool which was fine and clarified by the second agent.

The $1000 requirement appears to be because for a tax invoice to be a proper tax invoice it requires buyer details on invoices of $1000 or more according to the ATO.
