    Just out of curiosity, why do you charge for "transit cover" in the first place?

    "Items lost or damaged in transit are not covered by Phonebot unless transit cover is added"

    This is false, under ACL if an item is purchased and either lost or damaged in transit the onus is entirely on the seller to either refund or replace the item, regardless of any payment for "transit cover" - this right cannot be waived by a consumer for not purchasing additional cover, regardless of if they pay extra for transit cover or not

        Phonebot is responsible.

        Our contract of purchase would be with Phonebot.
        ACL covers the thing arriving and in the condition it was purchased under that contract.
        Any contracts Phonebot has with AusPost are not the responsibility of the customer im afraid.

        Example from Consumer Affairs Victoria (ACL is the same in all states):

        Johnny went to a store to purchase a new refrigerator. The cost included delivery by the store.

        On delivery of the new fridge, Johnny noticed its door handle was broken. He contacted the store, who said the damage must have occurred in transit and was not a fault with the product. However, this was incorrect – the store had an obligation under the consumer guarantees to supply a product of acceptable quality. The product has a major problem, so Johnny could choose either a refund or a replacement product.

        If I purchase an item from you, and I don't receive the item or the item is damaged, you are responsible for making things right as you have not supplied the product I purchased.

            Australian Consumer Law says you are responsible for providing the goods customers purchased. Please see the link and the example above.

            The customer's contract with you has nothing to do with any 'transit cover'. That is the vendors responsibility.

            By denying customers legal rights if they don't have your 'transit cover' you would be in breach of the law and potentially subject to legal action by the ACCC.

        I know for the fact that the store can claim for the loss and damages without the transit cover. You are just milking your customer's money.

    I hate abusive use of the word refurb. It's just a used, second -hand item, and stop misleading any more.
