Car Crash What Do - (Both Insured)

Car A conducting 3 point turn.
Reverses into driveway
Car A still on road, unsure if still occupying car B's lane for whole period, nose close to centre of road.
Car B passes in front of car A, Car B is squeezing past can see from their trajectory that they are mounting the kerb as they pass the front of car A.
Car A drove forward and makes contact to Car B's tail.
Cosmetic damage to car A.
Car B panel damage.
Car A doesn't intend to claim, Car B's insurance contacts driver A asking for statement / dashcam footage.
Car A has comprehensive insurance.

What is next course of action for A. Just file a claim and let insurers deal with it?

Is car B at fault if Car A is still occupying Car B's lane for whole period?

I feel it's likely Car A's fault unless it can be proved that car A was occupying car B's lane for the whole time.

    Go back in time and get a dash cam
    also Car A needed to make sure it was clear, obviously your fault

      You can bet that in any accident, the other driver will always have a different story which puts you at fault.

      Dashcams do help to avoid this.

      But clearly any driver making the 3 point turn must do so safely and give way to all traffic.

      Also - Do not fight the insurance companies - You will lose.

      Let your insurer sort it out

      I dont even know what the point of this excercise it as the answer is blatantly obvious

      I mean yea, but I just thought you say here's my insurer speak to them. But apparently not.

        Once it's with your insurer, you should not have to talk with the other party or their insurance. Your insurance is supposed to deal with everything.

          The pop up says you need to book in for an assessment to advance the claim and pay exess.

          Seems a bit backwards, I thought when you are fully comp you would just provide your policy details. And provide your insurer an account of the events.

    Why is car A manoeuvring like that to reverse into a driveway? You stay in your lane, continue briefly past the driveway, reverse into said driveway*.

    *Unless I have completely misunderstood the OP which to be fair is quite plausible.

    Edit: after rereading a few more times I missed the 3 point part. I thought they were trying to reverse into driveway to stop there.

      Well done for reading it three times. I had a mild stroke after reading it twice and had to give up before figuring out wtf has actually happened.

      Yes, that is what I would do too.

      But the driver crossed into the other lane to make the manouver easier.

  • What to do? Hand it over to your insurer and let them sort it out. This is what you pay them for? What's the point in paying them if you never plan on using it.

    Car A… sucks to be you. You must give way when entering or leaving a road related area.

    Car B is allowed to go around you on the opposite side of the road as you are an "obstruction" in their lane. You are making a 3 point turn, you need to give way to them, especially if you are half way up someone's driveway.

      Provided insurer info other party.

      Other party's insurance is asking for version of events and dash cam. They say they don't speak direct to them.

      So option seems provide info to their insurer or file a claim.

    Seems weird filing a claim when a car A sustains no damage. I thought the process was.

    Notify Car A insurer > give statement and dashcam > give insurance details to car B insurer > insurer A and B liase and decide fault and recover cash from at fault party

    • Yes impatient is the word for the situation here. Don't let your emotions control you when driving and don't judge. Everyone's learning and sometimes people have days worse than yesterday. So stay calm and keep a distance from idiots (yes you see I'm judging again) and let ample of time for your trip.

    They'll most likely say you're both at fault and you'll both have to pay excess.

  • I did some measurements of the road from visible angles from the dashcam.

    Road width = 5.3m

    Blind spot from front of car A to road as viewed from dashcam = 2.5m

    And the kerb is obstructed at the point that the car turns round.

    From these measurements it seems that car A was still in Car B's lane for the whole of the manauver
