Found a new RTX 3060 12GB on ebay for $360. Seller has no prior transactions and their store page looks dodgy af with bitcoin logos and girls in lingerie haha. I'm almost certain it's not legit but the stingy deal goblin in me wants to buy buy buy.

Well if it was brand new, why would he open up the box to take pictures of the card in the wrapper (which conveniently doesn’t show the security tape sealing the wrapper)? It’s almost certainly not brand new. And the fact that it’s the FHR version which NVIDIA stopped making a few years ago, it’s hard to imagine that someone would buy one and just let it sit for a few years.

Also, eBay normally sides with the seller, so if you get a box with a brick in it you have no recourse, even via PayPal who will force you to deal with eBay.

My experience (as both buyer and seller) is the opposite, they side more with buyer.
I always buy expensive electronics from sellers with 0 feedback.
