Vinyl Laminate Floor of 3yr Old House I Contructed Coming off. Am I Covered under The Standard Builder Warranty?

I got a home built in NSW in 2021, which is my PPOR. Over last few months, the vinyl flooring on my house is coming apart. It is peeling off at multiple places, some boards have started moving up and down and it is generally just coming apart.

Having never had any experience in handling this, how do I go from here? First, is this part of the warrant of the build? If so, how do I go about approaching the builder?

I want to be in a better place to know and understand my rights even before I approach them, if that is the right approach.

Any guidance will be appreciated. Thanks.

    • NSW. The builder is a local builder in the area where I live.

      I have a 7 year build warranty, but have no idea what it actually covers. I was hoping someone can guide and advise me. Or share an experience.

      • All builders vary in experience and I have heard some can be like pulling teeth to get stuff fixed.

        Just contact them and explain the issue, request an assessment and then go from there. Might be worth seeing if you can get a second opinion from a flooring person who can advise what the actual issue might be as well. Then you can see whether the builder is telling the truth or not.

        Cheer what the 7 Year Warranty Covers, you would need more details on this to have a more accurate understanding on whether the flooring is included or not. A quick google says:

        Workmanship and Materials: Builders' warranties often cover problems arising from poor workmanship or the use of substandard materials. This includes aspects like carpentry, flooring, and paintwork. If these elements fail or show defects within the warranty period, the builder is responsible for the repairs.

        But it could vary.

    It depends.

    Is it a defect in materials and labour or just high level of traffic leading to wear?

    Was there maintenance requirements? They should have given you the data sheet which shows warranty and maintenance requirements.

    NSW Home Building Act 1989:

    • Structural defects: 6 years
    • Non-structural defects: 2 years

    You might have just missed the time period we're they are legally liable, but they might fix it in good faith. I would say approach the builder on good terms.
    It may not even cost them if they can get it done under the manufacturer's warranty.

  • Was it installed directly to floor boards? Pretty sure vinyl on timber, requires underlay. Have you got that?
