Right to Disconnect and Unfair Times

Hi guys

I have a friend who is working
Basically she is the manager. But in her contract is on call basically forever day and night overnight etc (unless she's goes on leave).

Just checking she doesn't reimbursed- it is just part of the overall package
I always thought this was unreasonable?

And how does the right to disconnect affect her…it states in fairwork right to disconnect doesn't apply if reimbursed…my under is she doesn't get reimbursed…it is just part of her package.

    It seems reasonable that someone who is a manager of a nursing home be contactable outside normal hours.

    This would be part of her role and level of responsibility.

      Contactable yes, but contacted regularly no. There should be adequate procedures and delegation in place that the need to contact a manager out of hours is infrequent for none routine and serious issues only.

    I mean she is getting paid (reimbursed) according to the conditions associated with the role? Starting point would be to work out the specific award she’s on , and compare it to the minimum requirement and see if she’s getting a bad deal or not.

    And then there’s the usual suggestion of look for a better role elsewhere.

    Most contracts I've seen generally have 'hours required to complete the position' and generally state that renumeration is based on this. As a manager you have to expect to manage the business. This generally doesn't mean 9-5 but hours as required. Presumably she is paid more than her staff who work equivalent hours.

    Sometimes as a manager the 'right to disconnect' would be on your friend. If the team is full and well trained then they may be able to handle minor emergencies without getting in touch. I try to foster automomy within my team so that I don't have to be on call for minor issues.

    I feel sometimes that you get an extra 10% pay to do 25% more work with 50% more stress with every promotion you get

    Your song doesn't rhyme, limiting its commercial success.

    But in all honesty, it's the modern Australian work system to make employees do "reasonable" unpaid work. We all love doing work we don't get paid to do. We are somewhere between European civilised working hours and American dog eat dog hustle culture jobs with only two weeks off per year. Don't try to take them all at once though.

    It's a strange hybrid.

    ive worked in many roles where there is some aspect to answer the phone out of hours - eg your team working over night, or on weekends.
    its usually pretty easy 5 min on the phone and then just take an hour of bludge time during your standard hours.

    She might love the job, or the pay.

  • Manager's package likely above award = in the package = does get reimbursed for it.

    Probably gets the occasional 5-10 min call outside of hours, sure, its slightly irritating sometimes. However its a two-way street, he/she probably gets the occasional personal issue to deal with in work time for 5-10 mins like a call to arrange something too…
