What Are My Options if a Tradie Doesn't Show up after Having Already Paid a Deposit?

My wife and I recently asked a carpenter to come out for a quote on above garage storage. We'd used the guy for another job previously, and he did a good job so we were open to using him again. To my knowledge he was legit, and has an ABN.

He came out to do the quote, and asked for a 50% deposit to be paid before coming out to do the job, which we did via bank transfer (obviously moral here is never pay a 50% deposit), but long story short never came out to do the job and has been uncontactable via phone or email for weeks.

There is no contract apart from the invoice. I've contacted my bank, who have "requested" a reversal of funds, but apparently this doesn't do much, and I've made complaints to the ACCC and Consumer Protection, but again don't expect much from them. I'm aware of putting in a claim via the magistrates court, but I feel like the fees will exceed the amount of money we're out of pocket (< 2k).

Has anyone been in this situation before? We feel completely blindsided and feel like there's been not much support. So many of these tradies will not start work until a deposit has been paid, and so I don't think I can even chalk this up to a "learning experience".

    Call for a quote at a mate's place then be there when he rocks up

      • With the other half of the invoice to make sure he doesn't run away with just half the money!

    • Have a serious guy and comedian guy to balance it out to catch a tradie.

      I was about to say the same thing having just done 2 bathrooms & a kitchen but that's not the case.

      Full payment prior to delivery:
      Tiles
      Bathroom fittings.

      Deposit:
      kitchen cabinets (10% to start cutting; 80% on delivery; 10% on completion)
      manufactured stone benchtops (50% to cut; 50% on completion).

      A separate $5k roofing job 2 weeks ago was 50% deposit despite only having $50 of materials. I wasn't happy about this but roofers are very hard to get so I had to suck it up.

        $50 in mats after markup flatout getting 2 tubes of selleys 401.

        • Several tubes of ACE Gutters roof & gutter silicone, a 75x50 gutter penetration & 2m of downpipe. It was a $4.5k job.

          I've got a crew doing 4x5m sections of gutter, 4x9m off downpipe, pipe reline & other bits & bobs at another property for $ 14k and no deposit required.

    To be honest, its a nice website to be a scammer company. The reviews are pretty good for many years until the last month or so, so I'm guessing something has happened to the guy.

    If you look at the 'newest' reviews on both Google/facebook, they all seem to be good, but then turn south like your review, (I assume you're KY L) in the last month or so. Quoted, deposit paid but hasn't shown up. So yeah something happened.

      As a vague parallel when I was in school I texted my maths tutor that school holidays were ending and I was looking to start lessons again. He didn't respond for almost two weeks, with me getting more and more annoyed. Then I got a text from his daughter saying he had passed away..

    He might be a scammer or might just be sick or have something big going on in his life.

    In any case, can’t hurt to take a little drive past his place or get someone else to try calling to suss it out more then play it from there.

    Bank reversal seems unlikely after a few weeks.

    Here is his ABN 32613916945. Cormac Loughlin, Irish lad. Did he charge you GST? because he's not registered for it.

        If you make less than a certain amount you don't have to charge or pay gst.

        Seems like you got scammed.

        When you apply for an ABN, you can tick a box and register for GST if your expected turnover is $75000. He is not registered, meaning that he pocketed the GST.

        Contact consumer protection (its a part of DEMIRS) and lodge the complaint with them, theyll sort him but it wont be quick

        Also 50% deposit is way too high

  • Try sending a WhatsApp and see if it goes through as you can tell from the ticks. Does the phone ring?

    Looks like there are a couple of neg reviews recently - I take it you edited your original review he replied to. There is another though. I do wonder if something happened.

  • I have paid had to pay a 50% deposit a couple of times (~$2k) for someone to come and and do some work at our place. Luckily I haven't had any issues with them turning up and doing the work. But it was stressful knowing if they ghost you don't have much you can do, but they won't take the job without the deposit.

    There should be a better system because I understand tradies don't want to take on the risk of someone not paying as well. I try and pay via credit card because you can do a charge back if things go bad, but most don't accept it. Good luck!

      There used to be a better system, the tradie rocked up, did the work, you paid them, they left.

      For a long list of reasons, customers stopped paying them after the work was done, so now they want the money up front so they don't have to chase the money.

      I'm not really sure of any better options other than some escrow arrangement but they cost money to use, or a payment schedule so it is very much a trust thing between both parties.

      Deposits
      By law, a deposit can be no more than:

      10 per cent, if the total contract price is less than $20,000
      five per cent, if the total contract price is $20,000 or more.

      Which seems fair. Larger jobs will have progress payments, which also seems fair.

    It's possible his email got hacked and you paid the deposit directly into the hacker's bank account. Seen similar things happen for house deposits, etc.

  • Would having a third party holding the deposit until the job is done, be an idea worth looking into? Materials excluded if the buyer has them in their possession.

    This happened in sydney too. a bunch of irish scammers, go to the police, otherwise they will keep scamming and also go from door to door scamming old people, leaving flyers in mailbox etc

  • Faced something a tad similar when they received the full amount but did not finish repainting the cabinet.

    His daughter called back like 2 months later and said he had been hospitalised for some time in preparation for cardiac transplant. $2,800 for laminate floor, replacing toilet, install door and door stop and painting cabinet. We supplied parts. I ended up painting the cabinet myself. The guy was amazing it is hard to find tradies like him nowadays.

    If you are still interested in an attic I had "Total Attic Storage" do the basic package at my place and they did an amazing job. They are south of the river though.
