FT Work Break Time Entitlements

I have worked for a few different industries through the years but never really looked into the entitlement for our breaks for 8 hour shift.

from what I have been told in many scenarios you are meant to receive two breaks 30min paid and 10-15 min unpaid break, is it legal for company to only give 30 min break for full 8hour shift?

    My thoughts are you are spending 8 hours there already and now they expect you to work too. Seems harsh

    Other way around where I work. 10 minute paid and 30 minute unpaid.

    The answer greatly varies depending on your industry / award, there is no universal standard for how many paid breaks you get in a normal workday.

    In the restaurant industry for example:, is it legal for company to only give 30 min break for full 8hour shift? Answer: Yes, restaurant workers may only get a 30min unpaid break when working between 5-10 hours. There will be paid breaks of 20min if their break is scheduled for more than 5 hours after they start work.

    Close, but flip them around…. There is no set standard, and will come down to your award etc, so read your award/contract or enter it here

    But generally it could include 1 or 2 paid rest breaks (generally 5-15 mins depending on how many) as well as a 20 min unpaid meal break.

    The meal break is a minimum, you can have a 1 hour unpaid break in some cases if you want.

    Sorry went into government website states your entitled for two breaks?

    Full-time employees working between 7 to 10 hours a day are entitled to 2 paid rest breaks of 10 minutes and one unpaid meal break of 30-60 minutes.

      What is your industry/job?

      For an office worker its common to not have any fixed paid 'rest' breaks as such, as you are free to get a coffee break, walk around etc whenever you want.

  • yeah usually an unpaid 30 or 60min "lunch" break and 2 shorter (10min) breaks. Unless you're a smoker, then you get 6-8 mini breaks in addition to those ;)

    And this is a big reason why people continue to get ripped off. Sure, your employer should be paying you right though you're taking a big risk by not educating yourself. By educating yourself I mean starting on the fairwork.gov.au website for the facts. If you're seeking opinions, post on Ozbargain!

  • 8.5 hour shift 2 x 10 paid breaks and 1 x 30 minute unpaid for me.

  • For me 8 hour shift.

    2x paid 10 minute smoko's 1x 30 minute meal break.

    Can choose to take 1 hour but only 30 mins is paid.

    Healthcare under an EBA.
