@x x: yeah, some ozbargainers have got them through customers, you will want to get the programming cable as well to enable/disable frequencies to remove any chance of broadcasting on restricted frequencies.

That's heavy fines if you are caught actively transmitting on private frequencies. Baofeng radios are not preprogrammed with the encrypted police radio channels used in NSW, and very few of them work with the GRN (well, at least not on both channels).
The radio locator vans will be sent out if there is a serious breach. The 2004 incident in Perth for Scott Bradley Pike appears to have ended with a 6 month suspended prison sentence, because he made a bomb threat, and said another plane was on fire. There was a lot more going on with that person than just using a ham radio on airport frequencies.

If you use a Baofeng correctly programmed for Australia's UHF frequencies, without it being "misuse" or "interfering with public safety", then how is anyone going to know?
That said, if you don't know how to program the Baofeng's for the correct UHF frequencies, spacings and so on, then don't get one.

Got any examples of someone having a Baofeng or similar programmed correctly to Australian CB Frequencies and used correctly, without threats or violence or interference of emergency channels, and ACMA have put them in prison for 2 years or fined them $400K? Or in fact having just having the radio confiscated?
