Commercial Business Is Creating Ordour - Is There Anything You Can Do?

We have a commercial business in our building that is creating odour.
For privacy i don't want to say what type of business it is. You can say it is micro scale factory where people working do wear masks when they work.

The managing real estate agent is unreasonable and essentially telling to 'deal with it'. This was surprising as one would have expected first response is to do some checks by professional around ventilation, etc.

Either way, just curious if there is any further action that can be taken or something you just need to bear with it?

P.s. I am expecting some smart comments. No it is definately not any illegal type business :). It is food related.

    • A caramel popcorn cart on Rundle Mall smells amazing. I want to buy the machine they use just to get my house smelling like that instead of just smelling like my unwashed slippers.

  • i would complain to the council, keep a diary of when the smell is bad, wind direction etc…
    some businesses have restrictions put in place on hours they can operate or inability to operate (certain aspects of business) when wind is at a certain strength and blowing in a certain direction.
    really need to keep the complaints coming in thick and fast to the council, get all people that are impacted to complete the similar diaries and also complain to the council.

    make sure its a legitimate complaint and not about a restaurant with 'smelly' food or something else as frivolous.

    Food smells? Probably you don't have the right to not smell food. KFC and Hungry Jacks have been dumping smells into the surrounding suburbs for decades now.

    If it were chemicals or whatever, yeah maybe you could compel them to stop or pay you to shut up.

    Is the business producing odour, which is smell, or ordure, which is excrement, ie shit?

  • If you spray your house with ammonia the smell goes away.

      Easier just to spray the ammonia up your nostrils.

    Talk to council?
    A steak place had to close because it was stinking out nearby residents - but residents might have more protections of "quiet enjoyment" than a business.

    • Thanks. This is really helpful. Obviously this is extreme. We wouldn't want someone to close their business. However, the acting agent needs to take the request seriously and take appropriate action. However, good to have reference on what could happen in worst case scenario

  • Just wondering if you have, actually, talked to the business owner before you go to the council and EPA? Were they willing to remedy this? If not then it adds weight to your complaint.

    • That's the plan.
      This is all going through strata. I would check with them if business owner is aware of the response from managing agent.

      To be honest, we where surprised. If I was the business owner I would expect where I would work together and focus on how to resolve the problem.

        It is probably going to be an awkward conversation but they may not be aware of the effect they are having on you. Hopefully, they would prefer to sort it out with you, rather than bring in the regulations people. Best of luck.
