Claiming on Other Person's Insurance in Not at Fault Collision

I was rear ended and the other party has insurance. I initially claimed on my own insurance (Bingle) but they are only willing to repair at their own repairers and won't provide hire car, they said I must contact the other parties insurance directly for anything else.

What are my rights in this situation if I claim with the other party's insurance? Can I choose my own repairer and get a hire car? The other party's insurance repair quote centre is an hour and half away so would rather use local repairers.

    if you want to go through the hassle and hurdles of getting multiple local quotes, and sending them to the other parties insurance and negotiating the local repairer is your preferred option. Be prepared for the time spent going to the insurers preferred repairers to be likely be significantly less than the time you'll spend on the phone negotiating and then chasing up your preferred option though.
    They wont just accept a single quote from your 'preferred' local repairer though, unless they are one already on that insurers approved/preferred list.

      My local panel beater just require the claim number and they will handle the rest.

      They will also provide a hire car, just to make sure that you don't need to pay(excess) if you have accident on the hire car as the other party should cover for insurance on the hire car.

        but they wouldn't have to pay one on an accident you had in your own car.
        Not bad if you can swing it, but i've not seen that 'clause' before.

        • I got rear ended and NRMA covered with any accident on the hire car.

      Last time I got hit and couldn't find the culprit Bingle had my car repaired in 2 days which was much better than my old NRMA policy. Good experience and didn't jack up my premium so I kept them. Maybe I am due for a change in insurer.

    That is usually the case with the lower tier priced plans, no hire car included iirc? Been some years since I actually changed insurer and had to read a pds

    • I just assumed they could claim the costs from the other party since I'm not at fault. I'm guessing they are avoiding the hassle and telling me to claim myself.

    Ask the other party for their insurer details and claim number, and then deal with their insurer directly.

    As long as it's easy to determine who's at fault (and not you), tell the other party's insurer that you intend to use something like Right2drive or those accident-replacement vehicle vultures. They usually cough up a rental quick smart. It's cheaper for them to rent a rental for you than to go through those vultures.

    Find your preferred local repairer, explain what's happening, and they should have a rough idea of what you'll need to do.

    • It's driveable, not much damage so not in too much of a hurry.

    You are not a party in the insurance contract.

    You can claim whatever you need to be made whole again. Getting them to agree to it is a different matter and may require a lawyer and going to court.

  • If you want to claim on your own insurance you get what the policy determines. Make sure you reas the PImDI to deter.ijenif they are just rrying to stiff you.

    Alternative is to do your own leg work and claim off the other party's insurance.

    You may also be able to to continue your own claim and claim a hire car direct from the other party, but it adds compexity to the situation.

  • Dude, we had someone hit our car a few years back.
    Got a free rental as ours had to go on a tow truck.
    I think we used right2drive
    There is no cost to you, but this company claims it back from the other parties insurance.
    Pretty sure there are pamphlets at smash repairers.
    We still claimed via our own insurance and did not pay the excess.

    Go to any panel shop they will be able to seek the repairs from the insurance of the at fault just provide a claim number.
    They will also be able to provide a Not at fault hire vehicle.
