Trying to Delete EatClub Account (Data/Privacy options)

Hi, I'm not happy about being repeatedly called and/or messaged by EatClub.

I've followed the instructions

Which says:

Users have the right to request for their data to be deleted. If a user deletes their EatClub account, all personal data related to that account is deleted from our servers. If you would like EatClub to delete your data, please follow the steps below.
Open the menu profile by clicking the profile icon in the top left corner of the app
Open your profile
Click ‘Delete my account and personal data’ and follow the prompts to delete your data.

However, when I follow these instructions, an error message appears that says "Sorry. There was an issue deleting your account".

To me, it seems quite interesting that this is occurring.

Does anyone know if there is a government body to report this issue with EatClub to? Do they have an obligation to ensure the 'delete my account and personal data' option works?

I did contact them with the request and no reply so far.

They also won't let me delete all of my payment methods which I consider to be disgraceful.

Thanks

  • I have the EatClub app and I use it occasionally but only only with decent discounts.

Its been since COVID I;ve had it and never had any calls or messages from them other than push notifications about deals on the app.

What do they call you about?

Does anyone know if there is a government body to report this issue with EatClub to? Has anyone else experienced anything like this?

How does anyone think to report their issue to a government body first before even contacting the company

The Office of the Australian Information Commissioner (OAIC):
      https://www.oaic.gov.au/

If you’re concerned your personal information has been mishandled, you first need to complain to the organisation or agency you think has mishandled it. If they don’t respond to your complaint within 30 days or you’re not happy with their response, you can lodge a complaint with us.

        Thanks.

Still no response from EatClub to my request to delete my account and data.

I also still can't remove my credit card potentially leaving me exposed to a hack, data leakage or fraud.

I'll pursue your suggested option if it's not resolved.

i know europe has right to be forgotten laws and if you're an eu citizen you can request companies to delete your data and they have to comply. does australia have any equivalent? curious myself, because i have an account i created a month ago with an australian company for a specific purpose that i don't need anymore, and i intended to send them a request to delete my account in the next couple days, because there's no ability to self-delete in their portal. if they resist or flat out refuse, is there any legal persuasion that can be used?

tldr; does anyone know if australian companies have any legal obligation to compy with requests to delete accounts and personal data?

    • Thank you. This is what I would like to know too.

I’m not a lawyer but can confirm that the Australian privacy act does not provide a “right to be forgotten” clause - in short, companies have the right to hold on to your data “as long as it has a reasonable business purpose” (or something to that effect).

Small businesses also have no obligation to abide by the privacy act - a revenue requirement exists (something like $1mil, or at least it used to be).

Having said all of this - there are apparently reforms on the table. They’ve already been reviewed by the government, but both parties have dragged their feet with it.

Fwiw, a lot of companies won’t actually delete your data if you request it - just mark it as “do not contact”. This data hoarding is what makes security breaches so much worse than they have to be

  • You got an error message on an app - maybe message them about it 😅

  • I just wanted to add that the system also won't let me delete all of my payment methods.

How can they have the right to keep this data on file?

As above, there’s no legal requirement for them to delete your data.

It’s entirely possible you’re being subject to a “painted door” experiment - companies will add a button or form on their website that goes nowhere (but tracks your action), just to work out if people want/would use the feature. It’s so frustrating

Sorry, just read that there were instructions somewhere. Makes this suggestion pretty unlikely

      • Thanks for sharing.

Yes EatClub seems to be directing people to a dead end when it comes to account deletion.

      • You just said you were not a lawyer.

report to app store. if you can make an account on the app, you must be able to delete the account via the app

  • All good i'm look forward to seeing your personal info in the next data breach.

in any case i'm sure the CEO's email is definitely not some permutation of their first and/or last name + @eatclub.com.au

    • On that link, it says "If a user deletes their EatClub account, all personal data related to that account is deleted from our servers."

Can you confirm that all traces of data are removed from your systems including CRM purchase data and user identification as well as linkages to all payment details?
