    Nice find, though I have to ask what are you doing up at this hour looking at kayaks? I tried buying three for what it's worth but yeah couldn't past billing page as they couldn't calculate the shipping.

    This'll probably be a pricing error.

    youre dreaming if you think this will be honored, all kayaks are priced at this. obviously an error; not worth the pain of chasing a refund

    Bought two items.

    Got receipts for both.

    Called Anaconda store.

    Staff said it was a pricing error and all customers who purchased would be telephoned to say Anaconda would not be honouring the offer.

    Are there any legal experts who can advise on how I can enforce what is a clear contract of sale?

      If it was a genuine mistake, typographical error or they received wrong information from a supplier they can cancel the sale and credit the charge back to your credit card.

    I take it that if they charge your credit card, then that is a binding legal transaction. If they have not, then the transaction has not been completed and they can cancel. My 2c, I am no legal expert tho.

      No. Many people have had this opinion during previous sales and it has not changed reality. The difference between a system automatically processing a transaction and a person needing to do it manually is that your credit card details are not exposed to any people and you are more likely to have your order progress quickly. It is there for your security and convenience, not to be an automated contract maker.

        • I'm no legal expert but here goes:

          Under contract law there are three kinds of mistakes: unilateral mistakes, mutual mistakes and common mistakes. To me this a fairly obvious case of the a unilateral mistake where the seller is believes their advertisement to be correct, hence including it on their webpage. However when a contract is formed, it must have mutual assent by both parties. Objectively speaking here any reasonable person will understand that this is a mistake by the seller, so if contested in court this contract is highly likely to be voided as mutual assent (common understanding) has not been reached.

        • I'm not disagreeing, just curious - at what point in a normal online sale (when there is no mistake) is the contract considered accepted by both parties? Does it involve confirmation or invoice from the seller?

          Not trying to stir the pot here, genuinely curious.

        • I think it's really quite simple - there will be a contractual term on their website somewhere (that you probably agreed to, without knowing it) to deal with these kinds of situations that will enable them to get out of it.

          EDIT: having said that, i can't find it in the T&C's.

  • Just got back from anaconda at Ashmore. The place is a mess. Prices are not matching up to stock on the shelves.
    Tactical gear for 60% off though was awesome!

    got a call they will be refunding the money and giving $25 voucher… strange how they know how to refund back into my account without me giving them the details. It means they are breaking credit card policy of storing credit card details….

    • Wot? Which policy is this? - if there is one, i'd say it talks about storage in the longer term, rather than within hours of the transaction, but i could be wrong (happens, sometimes).

      So you're saying you're $25 ahead? Should have ordered a kayak myself…

      • Yes… it is called PCI, all merchants who use credit card transactions must abide by. If not they will lose their merchant credit card facilities…

          I'd say there's more than enough wriggle room for Anaconda to store credit card details at least in the short term until they are sure the transaction is complete & legitimate. "Business … purposes" is pretty wide in scope.

          There is certainly no requirement to permanently delete credit card details the moment an electronic transaction is complete.

          Thanks for pointing out the PCI stuff out - wasn't aware of it.

        • They are permitted to store some details, but not completely everything to complete a transaction, ie cvv… and they must be stored separately in such a way so that if their systems are compromised there will be no mass leakage of customer information with credit card details. The fact that they can refund so easily like this means they are retaining cvv. This would raise questions about their IT security and compliance to regulatory controls.

        • How can it be anything but my opinion unless I can see their systems… But like I said earlier, if they do not store full details of the credit card, how else can they proceed with transactions… The cvv was designed with this exactly in mind. Credit card details are not suppose to be stored together so that someone can not just go and grab all the details and create as many credit cards as they want.

        • I have paid bills by credit card over the phone to an automated system without providing the cvv. All I'm saying is you have stated that they are doing something wrong, but you don't know that as a fact.

        • As a merchant myself all you do is login and click on refund. I don't see any credit cards details. Ever. Www.eway.com.au. the actual store does not store your credit.info. it is held by companies like eway. When you login all you see is the persons name order ref. And amount paid.

  • I'm happy with the voucher, couldn't have expected anything more than getting my money back seeing that it was clearly an error. But it sucks so much that I got comfortable about having a inflatable boat that I want one now…..

    So what happens now ??
    Anaconda do not have to sell the kayaks because of the mistake in advertising,
    voided as mutual assent (common understanding) has not been reached
    BUT then advertised again for $23.98 The next day Friday 5th

    They are stating it wasnt their fault
    well guess what "Mutual Assent" was assesed and passed then they advertised and sold kayaks again so that then becomes a legal sale
    OR
    as the ACC and All States Fair Trading dept call
    Price Baiting

    WILL be interesting to see what they will say about Fridays SALES as these are legal sales.
