How to Open a Case on PayPal with Auto Payment and Win?

Hello all so I got scammed trying to buy art, the scammer faked on being another artist, linked them to me and shown me proof it was them, and the real artist even said it was them by mistake, though they had bad English and Russian.

I paid for the art $85 USD to a website called Boosty as it's the only place we can now pay to Russian artists. The scammer has ignored me and changed their username after i paid them.

Anyway I did not notice at time but Boosty takes payment as auto payment and on their TOS it says no refunds.

How do I open a case and win this? I'm not sure how to go about this, seems like its slim just because of auto payment.

Also have i paid many artists on this website and all is fine it's just this one, so I have used it many times already which will make this harder.

Has anyone else tried to dispute an auto payment and had any luck and what did you put it as?

  • Cop it on the chin and walk away.

  • Could try AFCA complaint after you have unsuccessfully complained to Paypal. Half the time PP will cave with a good will refund. Otherwise chargeback but PP will sell your debt so not a good idea.

  • Use PayPal internal processes first. Successful in cases against apple and Uber for double billing.

    How to open a dispute
    Log in to your PayPal account.
    Open a dispute in the Resolution Center within 180 calendar days of your purchase, by clicking on “Dispute a Transaction” under “Report a problem”.
    Select the transaction and click Continue.
    Select “Item dispute“.

    • yes i know how but I mean what kind of dispute do i mark it as and what do i even say since its auto payment

      • You can open a dispute if the item you receive is significantly different than how it was described. For example:

        You received a completely different item.
        Example: You purchased a tennis DVD, but received a tennis racket.

        The item's condition was misrepresented.
        Example: The listing said “new,” but the item was clearly used.

        The item is missing parts or features, and this was not disclosed.
        Example: You bought a table, and it showed up with only three legs.

        You purchased a specific quantity of an item, but received the wrong amount.
        Example: You bought two laptops, but received only one.

        The item was substantially damaged en route to its destination.
        Example: Your antique vase was broken in transit.

        You received a counterfeit version of the item.
        Example: A "genuine" diamond bracelet ended up being cubic zirconia.


        So the last one? I guess it really depends how the listing was actually described.
        Auto payment should be irrelevant? I assume you mean the function where you authorize the merchant like a subscription or pre-auth arrangement.

        • i didnt receive anything and yeah i mean the authorize and auto payment like subscriptions.
          i have messaged them asking what to do

          • @Rukiata: Mate you're making too many assumptions and being scared for no reason.
            Make a complaint to PayPal and it does NO matter where on the planet you sent the money to or if it was an auto payment.
            You made an auto payment through PayPal Australia which is bound by Australian Laws so now the matter is between you and PayPal.
            Item not received, end of the matter and I hope it's clear to you.

  • If you bought art and didn't receive art then you open a dispute saying you didn't receive what you bought. The fact that they are scammers/fraud is sort of moot - if they don't send what you bought then thats your grounds.
