Can I return to Dick Smith?

Hi all,

went out and bought a WD TV Live from dick smith yesterday, but it wouldnt read with any of my hard drives (500gb and 1.5tb) or my friends usb drives (4gb/8gb). Had tried different formatting i.e. FAT32 or NTFS, with no success.

Today I went back in trying to try and return it to them, but they wouldn't take it, because they as of recently don't accept returns of products where the package is opened. They also told me that the fault was with my usb/hard drives, and when I asked "All of them?", he gave no response.

Is there no other avenue through which i can return my product?

    It's not like its a change of mind purchase right from what they're suggesting it is.

      Well he shouldn't have to try another store, if it doesn't work then you should be able to return it to the store he bought it at no problems. Just say it doesn't work, and that you want a refund. Speak to the manager if they still refuse, say you'll be hearing from the ACCC. You will get your money then.

    I guess I'll be more demanding then tomorrow!

    • Tell him how would anyone know if somethings faulty until they open the package. The guy is effectively saying no returns which is against the law. demand he take it back again and if he doesnt time go to the accc or whatever their new name is. You can also complain to DSE headoffice.

  • According to Consumer Affairs (Victoria):
    You are generally entitled to return a product that:

    does not do what it is normally supposed to – for example, a toaster that does not toast bread
    has a defect – for example, a toaster with a timer knob that falls off soon after you buy it
    AND
    You are only entitled to a refund or replacement if the problem is major or cannot be fixed.

    If I were you, I would ask for a refund, no point dicking around with the same model. (no pun intended!)

    Ask the 'genius' at Dick Smith how to test the product without opening the box!

  • If they give you grief make them swap it for another one, stating it's faulty. Then return the unopened one at another Dick Store stating you simply changed your mind.
