Possibly Illegal Floorboard Installation within Strata Scheme

Hi guys, I have been having trouble with a neighbour above who are late sleepers and love to make all sorts of sounds from scratching, dropping objects onto the timber floor above late into the night. They moved in about 2 months ago.

Talking to them nicely has gotten nowhere, and strata is very slow to act, it's been a nightmare.

But what I would like to know is, if proper soundproofing was put in place in the beginning, none of the daily activities should be that audible. Their living room is right above our bedroom, if I remember correctly, there's a requirement that above habitable room, the sound transmitted need to be <35 dB.

Can I put pressure on strata to look up the renovation certificate for the timber floor as it directly causes us distress? If something like this was not properly documented in the minutes, it should be illegal and strata can make the owner rip out the whole thing and does something that meets compliance?

Help is appreciated in this matter, my fellow ozbargainers.

    Have you considered that some of the noises may be due to water hammer?     I sleep with music playing because it covers a lot of noise that would bother me otherwise. I'm assuming everyone else is so accustomed to my music that they would miss it if I turned it off. Having a noise stop start constantly is more annoying than constant background noise. And actually when I sleep it's like my brain silences the music even if it's quite loud, then when I half wake up I just have silence, but when I proper wake up when my alarm blares my brain insolences the music and I can hear it again. It's like psychological active noise cancelling or something.

    Anyway, have you tried leaving a TV or radio or streaming music going 24/7? Doesn't have to be loud to cover most noises. Might lift your mood too.

    You need to apply pressure to the Strata / Body Corporate to enforce its By-Laws / Renovation rules. There will be a government body within your state who can facilitate this process. Only the Body Corporate can keep the owners liable for a dodgy flooring install, and get the owners them to rip it up and do it properly according to the By-Laws / Renovation rules. Start keeping a diary of the times and noises heard - you will need evidence.
